Executive Order No. 422

EXECUTIVE ORDER NO. 422 September 11, 1990

ACTIVATING AND REORGANIZING THE ENERGY OPERATIONS BOARD AS THE ADMINISTRATIVE MACHINERY FOR THE EFFICIENT AND EQUITABLE ALLOCATION AND DISTRIBUTION OF ENERGY UNDER CERTAIN CONDITIONS

WHEREAS, there is a continuing uncertainty in the international crude oil supplies resulting in the increasing trend of world petroleum prices;

WHEREAS, it has become imperative that measures be adopted to cushion the impact of the increasing oil prices by insuring the efficient and judicious utilization of the country's energy supply in order to secure its optimum use consistent with the energy conversation thrust of the government;

WHEREAS, there is an urgent need to activate and reorganize the Emergency Petroleum Operations Board created under Executive Order No. 547 dated July 23, 1979 into the energy Operations Board as an inter-agency entity responsible for drawing an effective system for the efficient and equitable allocation and distribution of energy among the various end-users in the event of severe energy supply disruptions or imminent danger thereof, as maybe determined by the Board;

EXECUTIVE ORDER NO. 422

Activating and Reorganizing the Energy Operations Board as the Administrative Machinery for the Efficient and Equitable Allocation and Distribution of Energy Under Certain Conditions

- Establishes the Energy Operations Board to address uncertainty in international crude oil supplies and increasing world petroleum prices. (Sec. 1)
- The Board is responsible for:
    - Formulating policies, guidelines, and rules for energy/petroleum allocation and distribution. (Sec. 2)
    - Developing an overall plan for implementing the allocation and distribution system, including rationing schemes. (Sec. 2)
- The Board is composed of: (Sec. 1)
    - Executive Secretary (Chairman)
    - Secretaries of Trade and Industry, Agriculture, National Defense, Local Government, Transportation and Communications
    - Executive Director of the Office of Energy Affairs
    - A private sector representative designated by the President
- The Board shall designate an Executive Director to act as its Executive Officer on a regular and permanent basis. (Sec. 3)
- The Office of Energy Affairs shall act as the Board's Secretariat and provide administrative support. (Sec. 3)
- The Board shall constitute an Inter-Agency Technical Staff composed of representatives from all member agencies to provide technical assistance. (Sec. 3)
- Primary responsibilities of various departments: (Sec. 4)
    - Executive Secretary: Overall leadership in policy formulation and oversight
    - Trade and Industry: Classification of industrial/commercial sectors for prioritization, monitoring price effects
    - Agriculture: Representing agricultural production sector, especially small end-users in rural areas
    - National Defense: Enforcement of laws and regulations, providing security assistance
    - Local Government: Implementation, monitoring, and surveying end-users at barangay level
    - Transportation and Communications: Representing transport sector, especially public mass transport
    - Office of Energy Affairs: Energy sector representation, policy planning, and implementation
- Regional Inter-Agency Committees shall be established, chaired by the RDC Chairman, to oversee and coordinate implementation within the region. (Sec. 5)
- Provincial Inter-Agency Committees shall be established, chaired by the Provincial Governor, to oversee and coordinate implementation within the province. (Sec. 6)
- City Inter-Agency Committees shall be established, chaired by the City Mayor, to implement and monitor the allocation and distribution system within the city. (Sec. 7)
- Municipal Inter-Agency Committees shall be established, chaired by the Municipal Mayor, to implement and monitor the allocation and distribution system within the municipality. (Sec. 8)
- Barangay Councils shall be responsible for registering all end-users, overseeing equitable distribution, and reporting violations and issues within their barangays. (Sec. 9)
- In Metro Manila, the Metropolitan Manila Authority shall constitute the Metro Manila Inter-Agency Committee to oversee and coordinate implementation within the region. (Sec. 10)
- The Office of the President is authorized to provide necessary funding for implementation. (Sec. 11)
- The Board may call upon other government departments and agencies for assistance and support. (Sec. 12)
- Inconsistent issuances, orders, and rules are repealed or modified accordingly. (Sec. 13)
- The Executive Order takes effect immediately. (Sec. 14)
