EXECUTIVE ORDER NO. 105 December 24, 1986
AMENDING CERTAIN SECTIONS OF PRESIDENTIAL DECREE NO. 1519 TO STRENGTHEN THE PHILIPPINE MEDICAL CARE PLAN
WHEREAS, there is a need to strengthen the Philippine Medical Care Plan, otherwise known as the Medicare Program, to minimize and curtail abuses of the benefits provided for therein;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:
Sec. 1. Section 6 paragraph (m) of Presidential Decree No. 1519 is hereby amended to read as follows:
"(m) To render decisions, orders or resolutions on any investigation conducted upon its own initiative or upon complaint in writing for any violation of this law or its rules and regulations, and other notice and hearing; impose administrative fines of not less than P5,000 but not more than P30,000 against any person, natural or juridical, found guilty of such violation: Provided, That should the violation be committed by a hospital, drugstore, medical or dental practitioner, the accreditation so extended shall, in addition, be suspended or revoked: Provided, further, That should the...

Summary of Executive Order No. 105 Amending Presidential Decree No. 1519
Strengthening the Philippine Medical Care Plan (Medicare Program)
• Sec. 1: Amends Sec. 6(m) to allow the Commission to:
- Impose administrative fines of P5,000 to P30,000 for violations of the law or regulations.
- Suspend or revoke accreditation of hospitals, drugstores, medical/dental practitioners for violations.
- Suspend beneficiary's right to benefits for up to 6 months for violations.
- Decisions are appealable to the Office of the President.
- Administrative sanctions are without prejudice to penal provisions in Sec. 30.
• Sec. 2: Adds new Sec. 6(n) and 6(o) to allow the Commission to:
- Issue writs of execution for final decisions, orders or resolutions.
- Deputize law enforcement agencies to execute final decisions and serve processes.
• Sec. 3: Amends Sec. 15 to state that a member who violates the law or regulations shall not be allowed to avail of medical care benefits, subject to Sec. 6(m). The member must continue paying contributions during suspension.
• Sec. 4: Amends Sec. 29 to create a Hearing Committee to conduct inquiries and investigations into violations. The Committee can administer oaths, issue subpoenas, and punish contempt.
• Sec. 5: Amends Sec. 30 to increase penalties for failure to comply with the law or regulations:
- Fine of P10,000 to P40,000 or imprisonment of 6 months to 6 years, or both.
• Sec. 6: Repeals or modifies inconsistent laws, orders, issuances, rules and regulations.
• Sec. 7: Effective 15 days after publication in the Official Gazette.
