PRESIDENTIAL DECREE No. 545 August 28, 1974

AMENDING CERTAIN SECTIONS OF PRESIDENTIAL DECREE NO. 66, "CREATING THE EXPORT PROCESSING ZONE AUTHORITY AND REVISING REPUBLIC ACT NO. 5490", AND FOR OTHER PURPOSES

WHEREAS, under Presidential Decree No. 66, dated November 20, 1972, the Export Processing Zone Authority was created to implement the national policy of promoting the industrial development of the country through the establishment of export processing zones;

WHEREAS, it is imperative that the development of the government-owned industrial estate at Limay, Bataan be integrated with the Bataan Export Processing Zone, Mariveles, Bataan, in order to achieve maximum efficiency and economy;

WHEREAS, the expanded responsibilities and activities of the Export Processing Zone Authority arising from the above-mentioned integration will require the restructuring of the provisions of Presidential Decree No. 66, in order that the Authority can effectively meet the new challenge;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby decree and order:

Summary of Presidential Decree No. 545

Capitalization of the Export Processing Zone Authority (Section 1):
- The capital of the Authority shall consist of:
• Its existing assets and properties contributed by the Government
• All capitalized surplus
• Cash contribution of 400 million pesos from the National Treasury

Title to Real Property (Section 2):
• Public lands delimited as foreign trade zones under Proclamation No. 629, 899, and 939 shall be surveyed and conveyed to the Authority for 1 peso per parcel. (Section 24)
• Public land for low-cost housing under Proclamation No. 740 (amended by 900) shall be disposed as follows:
• 60 hectares to the Authority for 1 peso (Section 24)
• Balance to GSIS and/or SSS for developing housing units to sell to residents of Barrio Nassco and Camaya, excluding site development cost (Section 24)
• GSIS/SSS to develop residual area, including Authority's area, into modern communities with low-cost housing policy (Section 24)
• Housing units only for residents who worked continuously for 5+ years, as certified by the Authority (Section 24)
• If no qualified residents, GSIS/SSS can hold properties until sold (Section 24)
• Authority to administer, manage, and operate the housing project and issue necessary rules (Section 24)
• Authority can transfer ownership of Zone lands to registered enterprises, subject to Presidential approval (Section 24)

Industrial Estate at Limay, Bataan (Section 3):
• Management and operation transferred from Industrial Estate Corporation to the Authority
• Philippine Exclusive Corporations allowed to continue operations, subject to Authority's rules

Repeals and Modifications (Section 4):
• Inconsistent laws, orders, proclamations, rules, and regulations are repealed or modified accordingly
