AMENDING EXECUTIVE ORDER NO. 250 DATED 2 JUNE 1995 IMPLEMENTING THE RATIONALIZATION OF DUTY FREE STORES/OUTLETS AND THEIR OPERATIONS IN THE PHILIPPINES PURSUANT TO EO 140 AND FOR OTHER PURPOSES.
WHEREAS, under Sec. 4 (f) of RA 6768, balikbayans, as defined therein, are entitled to buy one (1) item of every product of non-consumables, whose selling price exceeds Two Hundred United States Dollars (US $200.00);
WHEREAS, balikbayans and overseas contract workers are clamoring for their entitlement to buy such duty free imported heavy durables;
NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:
SECTION 1. Section 5 of Executive Order No. 250 dated 2 June 1995 is hereby amended to read as follows:
"SECTION 5. Allowable Items in duty free shops. C The range of items to be sold by duty free stores/outlets operated by Duty Free Philippines outside of special economic zones /freesports established pursuant to RA Nos. 7227 and 7916...

Amending Executive Order No. 250 Implementing the Rationalization of Duty Free Stores/Outlets and Their Operations in the Philippines
Provisions:
• Balikbayans, as defined in RA 6768, are entitled to buy one item of every non-consumable product whose selling price exceeds $200 (Section 4(f) of RA 6768).
• Balikbayans and overseas contract workers are clamoring for their entitlement to buy duty-free imported heavy durables.
Section 5 of Executive Order No. 250 is amended as follows:
• Duty-free stores/outlets operated by Duty Free Philippines outside special economic zones/freeports can sell:
- Consumables
- Light durables
- TV sets not manufactured in the Philippines
- Locally manufactured heavy durables
• Imported heavy durables can only be sold to balikbayans, overseas contract workers, and residents of special economic zones/freeports at international ports of entry.
Proof of entitlement for availing the privilege:
• Filipino citizen continuously out of the country for at least 1 year:
- Philippine passport showing date of last departure (Section 5(a))
• Foreign passport holder:
- Foreign passport and any one of the following (Section 5(b)):
- Old Philippine passport
- Foreign naturalization papers showing former Philippine citizenship
- Certification from adopted country
• Filipino overseas contract worker:
- Passport and any one of the following (Section 5(c)):
- POEA-approved contract of employment
- Certificate of employment by foreign employer
- Certificate of employment by Philippine Embassy/Consulate
- Prior year's income tax return proving gainful employment abroad
- Seaman's Service Record Book
• Family members traveling with balikbayan:
- Passport and any one of the following (Section 5):
- Birth certificate (for children)
- Marriage certificate (for spouse)
- Adoption papers (for legally adopted children)
