AMENDING EXECUTIVE ORDER NO.43, SERIES OF 1992, BY MODIFYING THE MARGINS OF PREFERENCE AND THE APPLICABLE ASEAN PREFERENTIAL TARIFFS ON CERTAIN ITEMS INCLUDED IN THE COVERAGE THEREOF

WHEREAS, Executive Order No. 43, S. of 1992, modified the rates of duty on certain imported articles as provided for under the Tariff and Customs Code of 1978, as amended, in order to implement the 1991 and 1992 Philippine programmes providing a minimum level of 25% Margins of Preference (MOPs) Exclusion List, and deepening the MOPs in respect of certain items which are under the ASEAN Preferential Trading Arrangements;

WHEREAS, after the issuance of said EO No. 43, it became a necessary to modify the MOPs and therefore the applicable ASEAN preferential tariffs on certain items;

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, pursuant to the powers vested in me under Section 402 of the Tariff and Customs Code of 1978, as amended, do hereby order:

This Executive Order amends Executive Order No. 43 of 1992 by modifying the margins of preference (MOPs) and applicable ASEAN preferential tariffs on certain imported items.

Key Provisions:

- Annex "B" of Executive Order No. 43 is amended to modify the MOPs and ASEAN preferential tariffs for the items listed in Annex "A" of this Executive Order. (Section 1)
- The items listed in Annex "A" shall be subject to the ASEAN Preferential Tariff rates specified in Columns 12 to 18 of Annex "A". (Section 1)
- Annex "A" lists 57 items with their corresponding MOPs and ASEAN preferential tariff rates for the years 1994 to 2001. The items include:
  - Uncooked pasta products containing eggs or not containing eggs (Items 1-5)
  - Beer made from malt (Item 6)
  - Bituminous coal (Item 7)
  - Sodium hydroxide in aqueous solution (Items 8-9)
  - Phthalic anhydride (Item 10)
  - Packing containers of vulcanized fibre or plastics (Item 11)
  - Rubber products like camel back strips and vulcanized rubber thread (Items 12-13)
  - Bond paper and kraft board (Items 14-17)
  - Cartons and boxes of corrugated paper or paperboard (Item 18)
  - Woven fabrics containing polyester staple fibres (Items 19-27)
  - Flat-rolled products of iron or non-alloy steel, plated or coated with zinc (Items 28-35)
  - Tubes, pipes, and hollow profiles of cast iron or non-alloy steel (Items 36-40)
  - Tube or pipe fittings of cast iron (Items 41-42)
  - Corrugated sheets, plates, and strips of aluminium alloys (Items 43-47)
  - Room air conditioners and household refrigerators (Items 48-52)
  - Laundry-type washing machines (Items 53-55)
  - Parts of electric accumulators (storage batteries) (Item 56)
  - Colour television receivers (Item 57)
- All laws, orders, issuances, rules and regulations inconsistent with this Executive Order are repealed or modified accordingly. (Section 2)
- This Executive Order takes effect on January 1, 1994. (Section 3)
