AMENDING EXECUTIVE ORDER NO. 565, SERIES OF 2006, BY DEFINING THE ADMINISTRATIVE RELATIONSHIP BETWEEN THE DEPARTMENT OF LABOR AND EMPLOYMENT AND THE PROFESSIONAL REGULATION COMMISSION (PRC) AND DELEGATING THE PRESIDENTIAL POWER OF CONTROL OVER THE PRC TO THE SECRETARY OF LABOR AND EMPLOYMENT
WHEREAS, the Professional Regulation Commission (PRC) is an agency of government under the Executive Department that, pursuant to Section 17, Article VII of the 1987 Constitution, is under the control of the President of the Philippines;
WHEREAS, Executive Order No. 565, dated September 11, 2006, transferred the oversight functions of the Office of the President over PRC to the Department of Labor and Employment (DOLE), attaching the PRC to DOLE for general direction and coordination;
WHEREAS, the President retains the power of control over the PRC;
WHEREAS, the President sees it fit to delegate to the Secretary of Labor and Employment, as the President’s alter-ego, her control powers over the PRC.

Summary of Executive Order No. 565-A
Defining the Administrative Relationship between DOLE and PRC
- The Professional Regulation Commission (PRC) shall remain attached to the Department of Labor and Employment (DOLE) for general direction and coordination. (Section 1)
- The Secretary of Labor and Employment shall have supervision and control over the PRC. (Section 1)
Authority of the DOLE Secretary over the PRC
- Oversee operations of the PRC to ensure effective, efficient, and economical management, without interference in day-to-day activities. (Section 2a)
- Require submission of reports, conduct management audits, performance evaluations, and inspections to determine compliance. (Section 2b)
- Take necessary actions for proper performance of official functions, including rectification of violations, abuses, and maladministration. (Section 2c)
- Review and pass upon budget proposals, but cannot increase or add to them. (Section 2d)
Additional Authority of the DOLE Secretary (Except for Quasi-Judicial Functions)
- Act directly whenever a specific function is entrusted by law or regulation to the PRC. (Section 2a)
- Direct the performance of duty or restrain the commission of acts. (Section 2b)
- Review, approve, modify or reverse acts and decisions of the PRC or its officials. (Section 2c)
- Determine priorities in the execution of plans and programs. (Section 2d)
- Prescribe standards, guidelines, plans and programs. (Section 2e)
Repealing Clause
- All executive orders, rules and regulations, and other issuances or parts thereof that are inconsistent with this Executive Order are hereby repealed or modified accordingly. (Section 3)
Effectivity
- This Executive Order shall take effect immediately after its publication in a newspaper of general circulation. (Section 4)
