EXECUTIVE ORDER NO. 44

AMENDING EXECUTIVE ORDER NO. 571 (S. 2006) RENAMING THE PUBLIC-PRIVATE SECTOR TASK FORCE ON PHILIPPINE COMPETITIVENESS AS THE NATIONAL COMPETITIVENESS COUNCIL (NCC) AND EXPANDING ITS MEMBERSHIP

WHEREAS, Executive Order (EO) No. 571 (s. 2006) created the Public-Private Sector Task Force on Philippine Competitiveness;

WHEREAS, it is the collective desire of both the government and the business sector to jointly address the competitiveness indicators that will impact on our competitiveness ranking and strengthen our industry, agriculture and service sectors, create jobs and increase income as we move up the value chain;

WHEREAS, there is an urgent need to demonstrate our country’s commitment towards enhancing our competitiveness and upgrading our competitiveness ranking; and

WHEREAS, the President has the continuing authority to re-organize the administrative structure of the Office of the President.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by the virtue of the powers vested in me by law do hereby order:

Summary of Executive Order No. 44

Renaming and Reorganization of the National Competitiveness Council (NCC)
- The Public-Private Sector Task Force on Philippine Competitiveness is renamed as the National Competitiveness Council (NCC). (Section 1)
- The NCC is attached to the Department of Trade and Industry (DTI) and reports to the Economic Development Cluster. (Section 1)

Mandate of the NCC
- Promote and develop national competitiveness strategies. (Section 2)
- Push for the implementation of the Action Agenda for Competitiveness and link it to the Philippine Development Plan (PDP). (Section 2)

Composition of the NCC
- Chairperson: Secretary of Trade and Industry. (Section 3)
- Co-Chairperson: Private Sector Representative appointed by the President for a 2-year term, renewable for another term. (Section 3)
- Members: Secretary of Finance, Secretary of Energy, Secretary of Tourism, Secretary of Education, Director General of NEDA, and 5 Private Sector Representatives appointed by the President. (Section 3)
- The NCC shall meet once every 2 months or as convened by the Chairperson. (Section 3)

Powers and Functions of the NCC
- Serve as the primary collection point for investor issues affecting competitiveness in industry, services, and agriculture sectors. (Section 4a)
- Advise the President on policy matters affecting business sector competitiveness. (Section 4b)
- Provide inputs to the PDP, Philippine Investments Priority Plan (PIPP), and Philippine Exports Priority Plan (PEPP). (Section 4c)
- Coordinate, monitor, and ensure the implementation of key policy improvement processes associated with international competitiveness. (Section 4d)
- Recommend to Congress, through the Economic Development Cluster, proposed legislations that may contribute to competitiveness. (Section 4e)
- Coordinate with Local Government Units (LGUs) to ensure their policies, standards, plans, and budgets support the Action Agenda thrusts. (Section 4f)
- Coordinate with concerned agencies for the generation of resources, both governmental and non-governmental, local, national, and international, in support of the Action Agenda. (Section 4g)
- Act as the primary body to strategize and execute steps to improve the country's international competitiveness ranking. (Section 4h)
- Perform other powers and functions as necessary or assigned by the President. (Section 4i)

Secretariat
- The Department of Trade and Industry-Center for Industrial Competitiveness (DTI-CIC) shall serve as the NCC Secretariat, headed by its Executive Director, with the support of a private sector staff headed by an Operations Director. (Section 5)

Coordination
- The NCC shall regularly coordinate with industry/trade associations and local and foreign chambers of commerce to ensure the competitiveness of Philippine industries. They may be invited as resource institutions by the NCC. (Section 6)

Funding
- Five Million Pesos (Php 5,000,000.00) is allocated from the Contingent Fund of the Office of the President (OP) for the operating expenses of NCC. (Section 7)
- Thereafter, the annual budget of NCC shall be incorporated in the regular budget of the DTI, subject to existing accounting and auditing laws and procedures. (Section 7)
- The private sector shall provide funding for its own activities. (Section 7)

Separability Clause, Repealing Clause, and Effectivity
- The provisions of this Executive Order are separable, and any part declared invalid or unconstitutional shall not affect the other provisions. (Section 8)
- All other issuances or parts thereof inconsistent with this Executive Order are repealed or amended accordingly. (Section 9)
- This Executive Order shall take effect immediately upon publication in a newspaper of general circulation. (Section 10)
