M a n i l aPRESIDENTIAL DECREE No. 1221
REQUIRING ALL PHILIPPINE OWNED/AND OR REGISTERED VESSELS TO UNDERTAKE REPAIRS AND DRYDOCKING WITH MARINA-REGISTERED SHIP REPAIR YARDS.
WHEREAS, the promotion and maintenance of the Philippine ship repair industry is a major government program that deserves priority attention;
WHEREAS, the Maritime Industry Authority has been tasked to enhance domestic capability for ship repair and maintenance;
WHEREAS, repairs undertaken abroad entail payment in foreign currency, thereby resulting to the depletion of the country's foreign exchange reserves;
WHEREAS, in furtherance thereof, it is imperative to ensure that, as far as practicable, all activities relating to the repairs, alteration, improvement, modification, re-conditioning, conversion or drydocking of Philippine owned and/or registered vessels be undertaken by local shipyards.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Republic of the Philippines, by virtue of the powers in me vested by the Constitution, do hereby order and decree the following as part of the law of the land:

Summary of Presidential Decree No. 1221
Objective: Promotion and maintenance of the Philippine ship repair industry
Provisions:
- All Philippine-owned and/or registered vessels shall undertake repairs, improvement, alteration, reconditioning, conversion or drydocking with MARINA-registered ship repair yards. (Section 2)
- Exemptions may be granted by the Maritime Industry Authority (MARINA) in the following cases:
1. Emergency or extraordinary repairs abroad due to collision, grounding, heavy weather, breakdowns, or other perils of the sea, where it is impracticable to bring the vessel to the Philippines. (Section 2.1)
2. Existing prior commitments or inadequacy/lack of service facilities of MARINA-registered ship repair yards, as determined by MARINA. (Section 2.2)
3. The Philippines is not one of the vessel's ports of call, in which case a waiver must be obtained from MARINA. (Section 2.3)
4. Other meritorious cases as determined by MARINA. (Section 2.4)
- MARINA shall promulgate rules, regulations, procedures, and guidelines for implementation. (Section 3)
- Violations may result in cancellation of the Certificate of Philippine Registry, a fine not exceeding PHP 5,000 for domestic trade vessels or PHP 10,000 for overseas trade vessels, or both cancellation and fine, at MARINA's discretion. (Section 4)
- Inconsistent laws, decrees, executive orders, or rules and regulations are repealed or modified accordingly. (Section 5)
- The decree took effect immediately upon issuance on October 17, 1977. (Section 6)
