Case Overview and Summary
Provisions on Reprinting Educational, Scientific or Cultural Books- Conditions for Reprinting (Section 1):
• When the price of any educational, scientific or cultural book, pamphlet or written material becomes exorbitant and detrimental to national interest, as determined by a committee.
• Only one printer can reprint a single title, authorized by the government. (Section 1a)
• Application requirements for reprinting, including title, author, original publisher, list prices, proposed reprinted price, number of copies, and applicant details. (Section 1b)
• Reprinting must be accomplished within 60 days from approval, otherwise the title can be applied for by others. (Section 1c)
• Existing reprinted titles must be registered with the National Library within 30 days. (Section 1)
- Royalty Payments (Section 3):
• Reprinter must pay at least 7% royalty of the Philippine list price for locally published books. (Section 3)
• Reprinter must pay at least 2% royalty of the foreign list price for books published in other countries. (Section 3)
• Royalties for non-resident authors, publishers or copyright owners must be fully remittable in dollars if desired. (Section 3)
- Dispute Resolution (Section 4):
• Conflicts or claims arising from the decree shall be decided by the committee mentioned in Section 1. (Section 4)
• The committee's order or decision becomes final after 15 days, unless appealed to the Office of the President. (Section 4)
• The Office of the President must decide the appealed case within 10 days after filing the appeal. (Section 4)

PRESIDENTIAL DECREE No. 400 March 1, 1974
AMENDING PRESIDENTIAL DECREE NO. 285
I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, and General Order No. 1, dated September 22, 1972, do hereby decree and order that Presidential Decree No. 285, dated September 3, 1973, be amended by amending Sections 1 and 3 thereof and adding a new Section as follows:
"Sec. 1. Whenever the price of any educational, scientific or cultural book, pamphlet and other written materials, whether of domestic or foreign origin, has become so exhorbitant as to be detrimental to the national interest, as determined and declared by a committee composed of the Secretary of Education and Culture, the Director-General of the National Economic and Development Authority, the Chairman of the Textbook Board and of the Director of the National Library, such book, pamphlet or other written material...
