PRESIDENTIAL DECREE No. 1707

AMENDING PRESIDENTIAL DECREE NUMBERED NINE HUNDRED SEVENTY-ONE AND FOR OTHER PURPOSES

WHEREAS, Presidential Decree No. 971 dated July 27, 1976 among other things, established an improved disciplinary system of the Integrated National Police.

WHEREAS, in the course of the enforcement of said Presidential Decree No. 971, it has been observed that there is a need for additional amendments to further strengthen said disciplinary system and attain fully the objectives thereof;

WHEREAS, it is imperative that immediate appropriate measures be taken to inculcate a deeper sense of discipline among the members of the Integrated National Police which will strengthen the people's faith in the law-enforcement agencies;

WHEREAS, Commanders of the Integrated National Police resort to disciplinary powers to instill discipline among the ranks; however, it is observed that for the more serious instances of police offenses, the existing disciplinary powers are inadequate to meet the necessity for prompt and effective discipline;

Summary of Presidential Decree No. 1707

Amendments to the Disciplinary System of the Integrated National Police

- Grants power to Commanders to place members in confinement or restriction (Section 5-A):
• Applicable to members charged, committed, complained of, or suspected of committing a crime or offense.
• Purpose is to ensure presence during trial and prevent further offenses.
• Written report required if confinement is ordered without formal charge.
• Escape from confinement or breaking restriction before release is grounds for dismissal.

- Allows summary dismissal of members without formal investigation (Section 8-A):
• Regional Director, Metropolitan Police Force Director, and Director General have this power. (Section 8-A)
• Applicable in three cases:
    • When charge is serious and evidence of guilt is strong. (Section 8-A(a))
    • When respondent is a recidivist or repeatedly charged with reasonable grounds of guilt. (Section 8-A(b))
    • When respondent is notoriously undesirable. (Section 8-A(c))
• Decision is appealable within 30 days to National Police Commission. (Section 8-A)
• Reversal of summary dismissal entitles member to reinstatement, position, rank, and payment of back salaries and emoluments. (Section 8-A)
• Summary dismissal must be done with utmost objectivity and impartiality. (Section 8-A)

- Repeals or modifies inconsistent laws, rules, and regulations. (Section 3)
- Effective upon approval. (Section 4)
