EXECUTIVE ORDER NO. 270 July 25, 1987

AMENDING PROCLAMATION NO. 94 PROVIDING FOR THE HOLDING OF LOCAL ELECTIONS PURSUANT TO THE SECOND PARAGRAPH OF SECTION 1, ARTICLE XVIII OF THE 1987 CONSTITUTION, AND APPROPRIATING FUNDS THEREFOR

WHEREAS, under Section I, paragraph 2, Article XVIII of the 1987 Constitution, the first local elections shall be held on a date to be determined by the President;

WHEREAS, in Proclamation No. 94, dated April 14, 1987, the date of the first local elections under the 1987 Constitution has been set on August 24, 1987; and

WHEREAS, after conducting a public hearing and consultations on the matter, and considering up to the present, the Commission on Elections is still occupied with the national canvass of the result of the May 11, 1987 elections for Senators and Representatives, leaving less than one (1) month for the extensive preparation required for said local elections, involving more than 16,000 local officials, the Commission on Elections has recommended that said date of the local elections be reset to November, 1987....

Summary of Executive Order No. 270

Election of Local Officials
- Elections for provincial governors, vice-governors, city/municipal mayors, vice-mayors, and members of Sangguniang Panlalawigan, Panglungsod, and Bayan to be held on Monday, November 9, 1987. (Sec. 1)
- All elected, acting, or officers-in-charge local officials shall be deemed automatically resigned upon filing of candidacy, not later than 30 days before the elections. (Sec. 1)
- If governor/mayor is a candidate but vice-governor/vice-mayor is not, the latter shall become acting governor/mayor until the election. (Sec. 1)
- If both governor/vice-governor or mayor/vice-mayor are candidates, an acting officer-in-charge shall be designated from: (a) Provincial/City/Municipal Administrator, (b) Planning and Development Coordinator, or (c) Secretary. (Sec. 1)
- Elected local officials shall assume office on December 1, 1987. (Sec. 1)

Election and Campaign Period
- Election period: September 10, 1987 to November 9, 1987. (Sec. 2)
- Campaign period: October 10, 1987 to November 8, 1987 (30 days). (Sec. 2)

Election Propaganda
- No posters shall be allowed anywhere except in COMELEC poster areas. (Sec. 3)
- Violators shall suffer penalties under Section 264 of the Omnibus Election Code. (Sec. 3)

Voter Registration
- Special registration on September 26, 1987 for voters turning 18 on November 9, 1987 or those who failed to register previously. (Sec. 4)
- COMELEC may order general re-registration in certain areas to eliminate illegal voter registration. (Sec. 4)

Conduct of Elections
- Governed by the Omnibus Election Code of 1985, as amended by Executive Orders 50, 94, 134, 144, and 162, unless further amended. (Sec. 5)

Appropriations
- ₱200,000,000 set aside from COMELEC's annual budget and savings for the local elections. (Sec. 6)
- Funds to be released automatically by DBM upon COMELEC's request. (Sec. 6)
- Deficiencies to be augmented from contingent fund or other applicable appropriations. (Sec. 6)

Repealing Clause
- All laws, orders, rules, and regulations inconsistent with this Executive Order are repealed or modified accordingly. (Sec. 7)

Effectivity
- This Executive Order shall take effect immediately. (Sec. 8)
