• Converts the J. H. Cerilles Polytechnic College in San Miguel, Zamboanga del Sur into a state college known as the J. H. Cerilles State College (Section 1)
Mandate and Course Offerings
• The College shall primarily provide higher professional, technical, and special instructions, promote research and extension services, advanced studies, and progressive leadership in agriculture, industry, arts, sciences, and other relevant fields. (Section 2)
• The College shall offer undergraduate and graduate courses in education, agriculture, fisheries, forestry, engineering, industrial technologies, arts and sciences, and other degree courses as deemed necessary by the Board of Trustees. (Section 3)
• The College shall also offer short-term technical or vocational courses within its areas of specialization to meet the needs of the province and region. (Section 3)
• The existing high school shall be transferred to the Department of Education, but may remain within the campus until transferred or students are accommodated elsewhere. The College may operate a reasonably-sized laboratory school if it has a department of education. (Section 3)
Powers and Administration
• The College shall have the general powers of a corporation as set forth in the Corporation Law, with administration vested in the Board of Trustees and the president. (Section 4)
• The governing body shall be the Board of Trustees, composed of representatives from various government agencies, faculty, students, alumni, and prominent citizens. (Section 5)
• The Board shall promulgate and implement policies in accordance with state policies on education, agriculture, science, and technology, as well as CHED policies and standards. (Section 6)
• The Board shall have specific powers and duties, including enacting rules and regulations, receiving and appropriating funds, receiving donations and legacies, fixing tuition and fees, adopting a socialized tuition scheme, authorizing construction and purchases, appointing officials and employees, approving curricula and programs, setting admission and graduation policies, awarding honorary degrees and certificates, establishing branches and research centers, providing fellowships and scholarships, delegating powers, authorizing external audits, collaborating with other institutions, entering joint ventures, developing linkages, adopting innovative modes of knowledge transmission, establishing participative decision-making policies, privatizing non-academic services, and extending the president's term beyond retirement age under certain conditions. (Section 7)
• The Board shall convene at least once per quarter, with a quorum consisting of a majority of members, including the CHED chairman or the College president. (Section 8)
Administration and Personnel
• The College shall be headed by a president who shall render full-time service, appointed by the Board upon the recommendation of a search committee, for a term of four years, extendible for another four years. (Section 9)
• There shall be an administrative council consisting of the president, vice presidents, deans, directors, and other officials, responsible for reviewing and recommending policies on administration, management, and development planning. (Section 10)
• There shall be an academic council consisting of the president and instructional staff with the rank of assistant professor or higher, responsible for reviewing and recommending curricular offerings, admission requirements, graduation requirements, degree conferment, student discipline, and academic policies and rules. (Section 11)
• The Board shall appoint a secretary to keep records and proceedings and communicate notices of meetings. (Section 12)
• The Treasurer of the Philippines shall be the ex officio treasurer of the College. (Section 13)
• No religious affiliation shall be a matter of inquiry in the appointment of faculty members, but no member shall teach for or against any particular church or religious sect. (Section 14)
• The incumbent head of the J. H. Cerilles Polytechnic College, if qualified, shall serve as the first president of the College, with the remaining term counted as the first term. (Section 15)
Assets, Personnel, and Funding
• All assets, personnel, records, and liabilities of the J. H. Cerilles Polytechnic College, except those belonging to the high school, shall be transferred to the College. The positions, rights, and security of tenure of personnel shall not be impaired. (Section 16)
• All government-owned land occupied by the J. H. Cerilles Polytechnic College shall be titled under the name of the J. H. Cerilles State College, but shall revert to the Province of Zamboanga del Sur if the College ceases to exist or no longer needs the land. (Section 16)
• Heads of national government bureaus and offices are authorized to loan or transfer apparatus, equipment, supplies, or detail employees for duty in the College, as needed. (Section 17)
• The amount necessary to carry out the provisions of this Act shall be charged against the current year's appropriations of the J. H. Cerilles Polytechnic College. Thereafter, sums necessary for the continued operation and maintenance of the College shall be included in the annual General Appropriations Act. (Section 19)
Transition and Implementation
• Within 120 days after the approval of this Act, the College shall: (1) submit a five-year development plan, including its program budget, to CHED for recommendation to DBM; (2) undergo a management audit in cooperation with CHED; and (3) set up its organizational, administrative, and academic structure, including the appointment/designation of key college officials. (Section 20)
• The provisions of Republic Act No. 8292 (Higher Education Modernization Act of 1997) shall form an integral part of this Act and serve as the governing charter of the College. (Section 21)
• All other powers, functions, privileges, responsibilities, and limitations to state colleges and/or its officials under existing laws shall be deemed granted to or imposed upon the College and/or its officials whenever appropriate. (Section 22)
• All laws, presidential decrees, executive orders, rules, and regulations contrary to or inconsistent with the provisions of this Act are hereby repealed, amended, or modified accordingly. (Section 23)
• This Act shall take effect upon its approval. (Section 24)

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. The J. H. Cerilles Polytechnic College in the Municipality of San Miguel, Province of Zamboanga del Sur, is hereby converted into a State college to be known as the J. H. Cerilles State College, hereinafter referred to as the College.
