AN ACT DEFINING THE POWERS, RIGHTS AND DUTIES OF THE VICE-MAYOR OF THE CITY OF MANILA, FURTHER AMENDING FOR THE PURPOSE SECTIONS TEN AND ELEVEN OF REPUBLIC ACT NUMBERED FOUR HUNDRED NINE, AS AMENDED, OTHERWISE KNOWN AS THE REVISED CHARTER OF THE CITY OF MANILA.
Section 1. Section ten of Republic Act Numbered Four hundred nine, as amended, is hereby further amended to read as follows:
"Sec. 10. Vice- Mayor. There shall be a vice-mayor who shall perform the duties of the mayor in the event of the sickness, absence or other temporary incapacity of the mayor, or in the event of the definitive vacancy in the position of mayor, until said office shall be filled, in accordance with law. If, for any reason, the vice-mayor is temporarily incapacitated for the performance of the duties of the office of the mayor, or said office of the vice-mayor is vacant the duties of the mayor shall be performed by the president pro-tempore of the municipal board. Defining the Powers, Rights and Duties of the Vice-Mayor of Manila
- Vice-Mayor's General Powers and Duties (Section 1):
• Performs duties of the Mayor in case of sickness, absence, or vacancy. (Section 10)
• Presiding officer of the Municipal Board. (Section 10(a))
• Administrative head of the Municipal Board, appoints officers and employees, and has direct control and supervision over them and the Board's equipment and properties. (Section 10(b))
• Prepares and submits the budget for expenditures of the Municipal Board before April 30th of each year. (Section 10(c))
• Has charge of disbursements of the funds of the Board. (Section 10(d))
• Provides information and recommends measures to the Board and/or the Mayor. (Section 10(e))
• Takes an active part in the city's fight against vice, immorality, and criminality. (Section 10(f))
• Has a group of at least 24 men under his direct supervision and control, including at least 8 lawyers with yearly salaries of not less than ₱7,200, and at least 16 qualified patrolmen with yearly salaries of not less than ₱4,800. (Section 10(f))
• Can request the Chief of Police to assign at least 5 men from the city police or detective force. (Section 10(f))
• The Vice-Mayor and his group are peace officers and exercise powers and duties provided in Section 37. (Section 10(f))
• Performs other duties assigned by the Mayor or prescribed by law or ordinance. (Section 10(g))
• Elected in the same manner as the Mayor and possesses the same qualifications. (Section 10)
• Receives a yearly salary of ₱18,000 and has a secretary and at least 20 personnel in his regular office force, appointed by him. (Section 10)
• Provided with a commutable housing allowance of not less than ₱6,000 per annum by the Municipal Board. (Section 10)
General Duties and Power of the Mayor (Section 2):
• Enforces and executes laws and ordinances within the city's jurisdiction. (Section 11(a))
• Safeguards and has control over the city's lands, buildings, records, money, credits, and other property and rights, except those of the Board. (Section 11(b))
• Ensures taxes and other revenues are collected and applied according to appropriations for municipal expenses. (Section 11(c))
• Institutes judicial proceedings to recover city property and funds, and defends suits against the city. (Section 11(d))
• Ensures executive officers and employees properly discharge their duties. (Section 11(e))
• Can transfer officers and employees within the same department without changing compensation, except those of the Board and the Vice-Mayor's office, with the approval of the Office of the President. (Section 11(e))
• Examines and inspects books, records, and papers of all officers, agents, and employees at least once a year. (Section 11(f))
• Provides information and recommends measures to the Board. (Section 11(g))
• Can attend and participate in Board sessions, but cannot vote. (Section 11(h))
• Represents the city in business matters and signs bonds, contracts, and obligations on its behalf. (Section 11(i))
