REPUBLIC ACT NO. 9138 June 08, 2001

AN ACT ESTABLISHING THE GUIMARAS STATE COLLEGE BY INTEGRATING THE GUIMARAS POLYTECHNIC COLLEGE IN THE MUNICIPALITY OF BUENA VISTA AND THE WESTERN VISAYAS COLLEGE OF SCIENCE AND TECHNOLOGY - GUIMARAS EXTENSION IN THE MUNICIPALITY OF JORDAN, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. There is hereby established a state college in the Province of Guimaras to be known as the Guimaras State College, herein referred to as the College, by integrating the Guimaras Polytechnic College in the Municipality of Buenavista, Guimaras and the Western Visayas College of Science and Technology - Guimaras Extension in the Municipality of Jordan, Guimaras. The Guimaras Polytechnic College campus in the Municipality of Buenavista shall become the main campus of the College.

Academic Programs and Objectives
- Offer undergraduate, graduate, and short-term vocational-technical courses in various fields like technology, agriculture, fishery, engineering, arts, sciences, forestry, business, health, computer, criminology, and nautical (Section 2)
- Promote research, advanced studies, extension work, and leadership in specialized areas (Section 2)
- Prioritize development of the Province of Guimaras through research and studies (Section 2)
- Existing high school to be transferred to the Department of Education, but may operate a laboratory school (Section 3)

Governing Body and Powers
- Governed by a Board of Trustees composed of representatives from various government agencies, faculty, students, alumni, and prominent citizens (Section 5)
- Board has general powers of administration and corporate powers (Section 4)
- Specific powers and duties of the Board include:
    - Enact rules and regulations (Section 7a)
    - Receive and appropriate funds (Section 7b)
    - Receive donations and legacies, exempt from taxes (Section 7c)
    - Fix tuition fees and other charges (Section 7d)
    - Adopt socialized tuition scheme for poor students (Section 7e)
    - Authorize construction, repairs, and purchases, exempt from taxes (Section 7f)
    - Appoint officials, faculty, and employees (Section 7g)
    - Fix salaries and grant leaves (Section 7h)
    - Approve curricula, programs, and disciplinary rules (Section 7i)
    - Set admission and graduation policies (Section 7j)
    - Award honorary degrees and certificates (Section 7k)
    - Establish branches and centers (Section 7l)
    - Establish research and extension centers (Section 7m)
    - Establish chairs, fellowships, and scholarships (Section 7n)
    - Delegate powers and duties (Section 7o)
    - Authorize external management audit (Section 7p)
    - Collaborate with other state universities and colleges (Section 7q)
    - Enter joint ventures with business and industry (Section 7r)
    - Develop consortia and linkages (Section 7s)
    - Develop academic arrangements for capability building (Section 7t)
    - Adopt modern modes of knowledge transmission (Section 7u)
    - Establish policy guidelines for participative decision-making (Section 7v)
    - Privatize non-academic services (Section 7w)
    - Extend term of outstanding College President beyond retirement age but not later than 70 years old (Section 7x)

Administration
- Headed by a President appointed by the Board for a term of 4 years, renewable for another 4 years (Section 9)
- Administrative Council reviews and recommends policies (Section 10)
- Academic Council reviews and recommends curricular offerings, admission, graduation requirements, and disciplinary rules (Section 11)
- Secretary appointed by the Board to keep records (Section 12)
- Treasurer of the Philippines as ex officio treasurer (Section 13)
- No religious affiliation inquiry for faculty appointment (Section 14)

Transition Provisions
- Incumbent head of Guimaras Polytechnic College to serve as officer-in-charge pending appointment of President (Section 15)
- Assets, personnel, records, liabilities, and obligations of Guimaras Polytechnic College and Western Visayas College of Science and Technology - Guimaras Extension transferred to the College (Section 16)
- Government lands occupied by the former colleges transferred to the College (Section 16)
- National government bureaus and offices authorized to loan or transfer equipment, supplies, and detail employees (Section 17)

Reporting and Funding
- President to file annual report to Congress (Section 18)
- Initial funding from current appropriations of former colleges (Section 19)
- Subsequent funding from annual General Appropriations Act (Section 19)

Implementation Timeline
- Within 120 days:
    - Submit 5-year development plan and program budget to CHED (Section 20a)
    - Undergo management audit in cooperation with CHED (Section 20b)
    - Set up organizational, administrative, and academic structure (Section 20c)

Other Provisions
- Higher Education Modernization Act of 1997 (RA 8292) forms an integral part of this Act (Section 21)
- Other powers, functions, privileges, responsibilities, and limitations of state colleges apply (Section 22)
- Repeals inconsistent laws, decrees, orders, rules, and regulations (Section 23)
- Effectivity upon approval (Section 24)
