REPUBLIC ACT No. 4271

AN ACT GRANTING RAFAEL C. AQUINO A TEMPORARY PERMIT TO CONSTRUCT, MAINTAIN AND OPERATE PRIVATE FIXED POINT-TO-POINT AND LAND-BASED AND LAND MOBILE RADIO STATIONS FOR THE RECEPTION AND TRANSMISSION OF RADIO COMMUNICATIONS WITHIN THE PHILIPPINES.

Section 1. There is hereby granted to Rafael C. Aquino, his successors or assigns, a temporary permit to construct, maintain and operate in the Philippines, at Manila and at such other places as Rafael C. Aquino may select, subject to the approval of the Secretary of Public Works and Communications, private fixed point-to-point and land-based and land mobile radio stations for the reception and transmission of wireless messages on radiotelegraph or radiotelephone, each station to be provided with a radio transmitting apparatus and a radio receiving apparatus.

Section 2. This temporary permit shall continue to be in force during the time that the Government has not established a similar service at the places selected by the grantee, and is granted upon the express condition that the same shall be void unless the construction...

Granting of Temporary Permit

Operation and Fees

- The grantee is liable for any accidents or injuries caused by the construction or operation of the stations. (Section 6)

Regulatory Compliance
- The grantee is subject to Philippine corporation laws. (Section 7)
- The stations can operate in the medium, high, and very high frequency bands assigned by the Secretary of Public Works and Communications. (Section 8)

Transfer and Assignment
- The permit cannot be leased, transferred, sold, or assigned without Congressional approval. (Section 9)
- Any entity to which the permit is transferred must comply with Philippine corporation laws and the permit conditions. (Section 9)

Government Control
- The President can order the closing or temporary use of the stations during war, insurrection, public peril, emergency, calamity, or disaster, with just compensation. (Section 10)

Amendment and Repeal
- The permit is subject to amendment, alteration, or repeal by Congress when the public interest requires it. (Section 11)
- The permit is not an exclusive grant of the privilege. (Section 11)

Effectivity
- The Act takes effect upon its approval. (Section 12)
