AN ACT INSTITUTIONALIZING A NATIONAL FACILITATION SERVICE NETWORK THROUGH THE ESTABLISHMENT OF A PUBLIC EMPLOYMENT SERVICE OFFICE IN EVERY PROVINCE, KEY CITY AND OTHER STRATEGIC AREAS THROUGHOUT THE COUNTRY
Be it enacted by the Senate and House of Representatives of the Philippines of Representatives of the Philippines in Congress assembled:
SECTION 1. Title. — This Act shall be known as the "Public Employment Service Office Act of 1999."
Section 2. Declaration of Policy. - It is a declared policy of the State to promote full employment and equality of employment opportunities for all, and for this purpose, to strengthen and expand the existing employment facilitation service machinery of the government particularly at the local levels.
Section 3. Establishment of the Public Employment Service Office. - To carry out the above-declared policy, there shall be established in all capital towns of provinces, key cities and other strategic areas a Public Employment Service Office, hereinafter referred to as "PESO," which shall be community-based and maintained largely by local...

Summary of Republic Act No. 8759 (Public Employment Service Office Act of 1999)
Title and Policy Declaration (Sections 1-2):
- The Act is known as the "Public Employment Service Office Act of 1999".
- It declares the policy of promoting full employment and equal employment opportunities by strengthening the government's employment facilitation service machinery, particularly at the local levels.
Establishment and Objectives of Public Employment Service Office (PESO) (Sections 3-4):
- PESOs shall be established in all provincial capitals, key cities, and strategic areas.
- PESOs will be community-based and maintained by local government units (LGUs), non-governmental organizations (NGOs), community-based organizations (CBOs), and state universities and colleges (SUCs).
- PESOs will be linked to the regional offices of the Department of Labor and Employment (DOLE) for coordination and technical supervision, and to the DOLE central office, forming a national employment service network.
- The objectives of PESOs include:
- Providing a venue for exploring various employment options and seeking assistance (Section 4a).
- Serving as a referral and information center for DOLE and other government agency programs (Section 4b).
- Providing information on employment and labor market situation in the area (Section 4c).
- Networking with other PESOs within the region for job exchange purposes (Section 4d).
Functions of PESOs (Section 5):
- Encourage employers to submit job vacancies to facilitate labor market information exchange between job seekers and employers (Section 5a).
- Develop and administer testing and evaluation instruments for job selection, training, and counseling (Section 5b).
- Provide access to livelihood and self-employment programs offered by government and non-government organizations (Section 5c).
- Undertake employability enhancement trainings/seminars for job seekers and career changers (Section 5d).
- Provide employment or occupational counseling, career guidance, mass motivation, and values development activities (Section 5e).
- Conduct pre-employment counseling and orientation for local and overseas workers (Section 5f).
- Provide reintegration assistance services to returning Filipino migrant workers (Section 5g).
- Perform other functions to carry out the objectives of the Act (Section 5h).
Other Services of PESOs (Section 6):
- Conduct periodic job fairs to bring together job seekers and employers (Section 6a).
- Conduct livelihood and self-employment bazaars to provide information on livelihood programs, particularly in rural areas (Section 6b).
- Provide special credit assistance for poor but qualified applicants for overseas employment (Section 6c).
- Implement the Special Program for Employment of Students and Out-of-School Youth (SPESOS) during summer and Christmas vacations, as provided for under Republic Act No. 7323 (Section 6d).
- Implement the Work Appreciation Program (WAP) to develop work appreciation and ethics among the youth (Section 6e).
- Implement the Workers Hiring for Infrastructure Projects (WHIP) program, requiring construction companies and government contractors to hire 30% skilled and 50% unskilled labor from the project area, as per Republic Act No. 6685 (Section 6f).
- Implement other programs/activities developed by DOLE to enhance employment assistance, particularly for special groups like persons with disabilities and displaced workers (Section 6g).
Role of DOLE and LGUs, NGOs, CBOs, and SUCs (Section 7):
- DOLE shall establish, operate, and maintain PESOs upon the request of LGUs, NGOs, CBOs, and SUCs that do not have existing PESOs.
- DOLE shall enter into memoranda of agreements with the concerned entities for the establishment, operation, and maintenance of PESOs.
- DOLE's responsibilities include:
- Establishing and maintaining a computerized national manpower registry of skills, employment, and business opportunities (Section 7a).
- Providing office space, equipment, supplies, and personnel to manage and operate the PESO (Section 7b).
- Designating a qualified project manager and/or key personnel for the PESO (Section 7c).
- Providing technical assistance and allied support services to the PESO (Section 7d).
- Training PESO personnel in employment facilitation functions (Section 7e).
- Extending/facilitating employment services, including conducting job fairs and other activities (Section 7f).
- Undertaking, monitoring, assessing, and evaluating the PESO program implementation (Section 7g).
- LGUs, NGOs, CBOs, and SUCs shall extend necessary assistance and services for promoting employment within their respective areas of jurisdiction.
Administration and Implementation (Sections 8-9):
- DOLE shall be primarily responsible for administering the PESO Program through its Bureau of Local Employment and regional offices.
- The Secretary of Labor and Employment, in coordination with the Department of the Interior and Local Government and in consultation with local government leagues, shall promulgate the necessary rules and regulations within ninety (90) days from the effectivity of the Act.
- The initial implementation of the Act shall be charged against the existing appropriation of DOLE and its other operating agencies.
- Subsequent funding for full implementation shall be included in DOLE's budget in the succeeding General Appropriations Act.
Repealing, Separability, and Effectivity Clauses (Sections 10-12):
- All laws, decrees, executive orders, rules, and regulations inconsistent with the Act are repealed or modified accordingly (Section 10).
- If any part of the Act is declared invalid or unconstitutional, the remainder shall not be affected (Section 11).
- The Act shall take effect fifteen (15) days after its publication in the Official Gazette or in at least two (2) newspapers of general circulation (Section 12).
