- The University of Northern Philippines (UNP) - Candon Branch (formerly Candon Community College) in Candon City, Ilocos Sur is separated from UNP in Vigan City and converted into a state college called the North Luzon Philippines State College (the College). (Section 1)
General Mandate
- The College shall primarily provide advanced education, higher technological, professional instruction and training in various fields like arts, sciences, education, entrepreneurship, engineering, agriculture, medicine, nursing, law, architecture, business administration, hotel and restaurant management, tourism, information technology, and other relevant fields. (Section 2)
- It shall promote research and extension services to support socioeconomic development of Ilocos Sur and provide leadership in its areas of specialization. (Section 2)
Curricular Offerings
- The College shall offer undergraduate and graduate studies in fields like arts, sciences, education, entrepreneurship, engineering, agriculture, medicine, nursing, law, architecture, business administration, hotel and restaurant management, tourism, information technology, and other degrees within its areas of specialization. (Section 3)
- No degree program shall be offered without the approval of the Commission on Higher Education (CHED) and the Board of Trustees. (Section 3)
Administration
- The College shall have the general powers of a corporation set forth in the Corporation Code of the Philippines. (Section 4)
- The administration and exercise of corporate powers shall be vested in the Board of Trustees and the President of the College. (Section 4)
The Governing Board
- The governing board shall be the Board of Trustees, composed of: (Section 5)
- Chairperson of CHED (Chairperson)
- President of the College (Vice Chairperson)
- Chairpersons of the Senate and House Committees on Education
- Regional Directors of NEDA, DOST, and DA
- Presidents of the faculty association, student council, and alumni association
- Two prominent citizens from the private sector
- The Board shall promulgate and implement policies in accordance with state policies on education and CHED policies under Republic Act No. 7722. (Section 6)
- The Board shall have various powers and duties related to promulgating rules, receiving funds, importing duty-free books, receiving donations, fixing tuition fees, authorizing construction and repairs, appointing officials and employees, approving curricula, awarding degrees, establishing branches and centers, entering joint ventures, and other administrative and academic matters. (Section 7)
- The Board shall meet at least once every quarter, and the Chairperson may call up to two special meetings with prior notice. (Section 8)
The College President
- The College shall be headed by a President who shall render full-time service and be appointed by the Board for a term of four years, renewable for another term. (Section 9)
- The President shall be assisted by Vice Presidents appointed by the Board. (Section 9)
The Administrative Council and Academic Council
- There shall be an Administrative Council to review and recommend policies on administration, management, and development planning. (Section 10)
- There shall be an Academic Council to review and recommend curricular offerings, rules of discipline, admission and graduation requirements, and academic policies. (Section 11)
The Secretary and Treasurer
- The Board shall appoint a Secretary to keep records and proceedings of the Board and College. (Section 12)
- The Treasurer of the Philippines shall be the ex officio treasurer of the College. (Section 13)
The Faculty
- No political beliefs, gender preference, cultural or community affiliation, ethnic origin, or religious opinion shall be a matter of inquiry in the appointment of faculty members, subject to the guidelines set by the Board. (Section 14)
- No faculty member shall teach for or against any particular church or religious sect. (Section 14)
Scholarship Program/Admission
- The College shall provide a scholarship program and other affirmative action programs to assist poor but deserving students. (Section 15)
- No student shall be denied admission due to gender, religion, cultural or community affiliation, or ethnic origin. (Section 15)
Academic Freedom and Institutional Autonomy
- The College shall enjoy academic freedom and institutional autonomy pursuant to the Constitution. (Section 16)
Authority to Loan or Transfer Apparatus/Equipment/Supplies and Detail of Personnel
- Heads of national government bureaus and offices are authorized to loan or transfer apparatus, equipment, or supplies needed by the College, and to detail employees for duty in the College. (Section 17)
Assets, Liabilities, and Personnel
- All assets, liabilities, personnel, and records of the UNP - Candon Branch shall be transferred to the College. (Section 18)
- The positions, rights, and security of tenure of faculty and personnel shall be respected. (Section 18)
- All government land occupied by the UNP - Candon Branch shall be titled under the name of the College. (Section 18)
Appropriations
- The amount necessary to carry out the provisions of this Act shall be charged against the current year's appropriations of the UNP - Candon Branch. (Section 19)
- Thereafter, sums necessary for the operation and maintenance of the College shall be included in the annual General Appropriations Act. (Section 19)
Development Plan, Management Audit, Organizational/Administrative/Academic Structure
- Within 120 days after the approval of this Act, the College shall: (Section 20)
- Submit a five-year development plan with program budget to CHED
- Undergo a management audit in cooperation with CHED
- Set up its organizational, administrative, and academic structure, including the appointment of key officials
Filing of Report
- On or before the 15th day of the second month after the opening of regular classes each year, the Board shall file a detailed report on the progress, conditions, and needs of the College with the Office of the President of the Philippines, CHED, and both Houses of Congress. (Section 21)
Suppletory Application
- The provisions of Republic Act No. 8292 (Higher Education Modernization Act of 1997) shall be an integral part of this Act and serve as part of the Governing Charter of the College. (Section 22)
CHED Monitoring and Evaluation
- CHED shall conduct regular monitoring and evaluation to determine continuing compliance with the requirements on college status. (Section 23)
- If CHED finds non-compliance, it shall recommend the revocation of the college status to the Senate and House Committees on Education. (Section 23)
Parity Clause
- All other powers, functions, privileges, responsibilities, and limitations to state colleges and/or their officials under existing laws shall be deemed granted to or imposed upon the College and/or its officials, whenever appropriate. (Section 24)
Implementing Rules and Regulations
- The Board, in consultation with CHED, shall formulate the guidelines to fully implement the provisions of this Act. (Section 25)
Separability Clause
- If any part or provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect. (Section 26)
Repealing Clause
- All laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the provisions of this Act are hereby repealed or modified accordingly. (Section 27)
Effectivity Clause
- This Act shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation. (Section 28)
