AN ACT TO ADOPT A PROGRAM TO STABILIZE THE PRICE OF PALAY, RICE AND CORN, TO PROVIDE INCENTIVES FOR PRODUCTION, AND TO CREATE A RICE AND CORN ADMINISTRATION TO IMPLEMENT THE SAME, AND TO PROVIDE FUNDS THEREFOR.

Section 1. It is hereby declared to be the policy of the Government that in order to stabilize the price of palay, rice and corn, it shall engage in the purchase of these basic foods directly from those tenants, farmers, growers, producers and landowners in the Philippines who wish to dispose of their produce at a price that will afford them a fair and just return for their labor and capital investment, and whenever circumstances brought about by any cause, natural or artificial, should so require, shall sell and dispose of these commodities to the consumers at areas of consumption at a price that is within their reach.

Summary of Republic Act No. 3452

Policy and Purpose (Section 1):
- The government shall engage in purchasing palay, rice, and corn from farmers, growers, producers, and landowners at a fair price to stabilize prices.
- The government shall sell these commodities to consumers at affordable prices when necessary.

Rice and Corn Administration (Sections 2-7):
- A Rice and Corn Administration is created under the Office of the President, with regional offices in Luzon, Visayas, and Mindanao.
- The Administration is governed by a Board of Administrators composed of a chairman and four members representing consumers, producers, and millers, appointed by the President.
- The Administration is managed by a General Manager and an Assistant General Manager, who are natural-born Filipino citizens with experience in the rice and corn business.

Procurement and Price Regulation (Section 8):
- The Administration must buy palay and corn from growers, producers, and landowners at the following prices:
    - Palay (ordinary variety, 45 kg): Not less than P11.50 nor more than P12.50 per cavan.
    - Corn (56 kg): Not less than P9.00 per cavan.
- Small farmers and tenants with production not exceeding 100 cavans are entitled to priority, and those exceeding 100 cavans can sell up to 25% of the excess.
- The Administration shall announce changes in floor prices for palay and ceiling prices for rice and corn at least two months before the planting season.

Consumer Prices (Section 9):
- The Administration shall sell rice recovered from purchased palay at not less than P0.80 nor more than P1.00 per ganta of ordinary variety.
- The Administration shall sell corn grits at not less than P0.40 nor more than P0.45 per ganta.

Powers and Functions (Sections 10-12):
- The Administration shall coordinate, supervise, direct, and control activities of existing government agencies related to rice and corn.
- The Administration shall provide incentives to farmers, growers, and producers, and acquire vehicles for procurement and distribution through public bidding.
- The Administration is authorized to inspect and record palay, rice, and corn stocks, and enter premises for inspection.
- The President can declare a rice and corn emergency, during which the Administration can conduct raids, seizures, and confiscation of hoarded rice and corn, subject to payment at the prevailing consumer's price.

Abolition and Transfer (Section 13):
- The National Rice and Corn Corporation is abolished, and its assets, liabilities, functions, powers, and personnel are transferred to the Administration.

Appropriations and Penalties (Sections 14-17):
- P100 million is appropriated for the capitalization of the Administration, with an annual operational expense limit of P3 million.
- Violators of the Act or its rules and regulations shall be punished with a fine of up to P10,000 and imprisonment of up to 5 years. Public officials shall also be perpetually disqualified from holding public office.
- Inconsistent laws are repealed or modified accordingly.
- The Act took effect upon its approval on June 14, 1962.
