PRESIDENTIAL DECREE No. 568 October 24, 1974

APPROPRIATING COUNTERPART FUNDS FOR THE PHILIPPINE POPULATION PROJECT AND CREATING THE PROJECT MANAGEMENT STAFF THEREOF AND FOR OTHER PURPOSES

WHEREAS, in order to make more effective the population program of the country, there is a need to augment the resources available to agencies involved in the said program;

WHEREAS, the International Bank for Reconstruction and Development (IBRD) has granted the Philippine Government a loan for the Philippine Population Project, hereinafter referred to as the Project;

WHEREAS, funds must be appropriated to finance the counterpart peso funding of the aforesaid loan agreement;

WHEREAS, there is a need to create a Project Management Staff for effective implementation and execution of the said Project;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in my by the Constitution do hereby decree the following measures as part of the law of the land.

Summary of Presidential Decree No. 568

Appropriations (Section 1):
- Appropriates P166 million from the National Treasury for the Philippine Population Project, funded by an IBRD loan.
- Funds to be released to the Project Management Staff in the following schedule:
  • P7.5 million for FY 1974-75
  • P24 million for FY 1975-76
  • P85 million for FY 1976-77
  • P43 million for FY 1977-78
  • P6.5 million for FY 1978-79
- Releases may be adjusted based on actual project requirements.

Project Management Staff (Section 2):
- Establishes a Project Management Staff under the Office of the Secretary of Health to:
  • Undertake and supervise the implementation of projects under the IBRD loan. (Section 2a)
  • Prepare and implement other development projects related to the loan as assigned by the Secretary of Health. (Section 2b)
  • Perform other functions related to the execution of the project as assigned by the Department of Health. (Section 2c)
- The Project Management Staff will be co-terminus with the project.
- Personnel may be absorbed by the Department of Health upon project completion if they meet qualifications.

Organizational Structure (Section 3):
- The Secretary of Health is authorized to determine the organizational structure of the Project Management Staff.
- It will be headed by an Executive Director and have technical, administrative, and support staff, as well as consultants.
- Consultants may be from the private sector on a consultancy or contractual basis, or from government agencies on a consultancy, part-time, or detail basis.
- Consultants may receive additional salary, overtime pay, honoraria, or allowances as fixed by the Secretary of Health.

Work Coordination (Section 4):
- The Department of Health and the Population Commission shall coordinate in the implementation and execution of the project.

Nature of Positions (Section 5):
- Positions in the Project Management Staff are exempt from the examination requirements of R.A. 2260 and the WAPCO rules and regulations on salaries.
- The Secretary of Health may delegate the authority to appoint or contract personnel to the Executive Director.

Contracts and Expenditures (Section 6):
- The Secretary of Health may contract the implementation of the project on a negotiated or administration basis if the amount does not exceed P400,000 per contract.
- This procedure is limited to projects fully or partly supported by foreign loans or tied to foreign-assisted projects.
- Advances, expenditures, and disbursements made by the Project Management Staff are not subject to procurement requirements or restrictions imposed on government agencies.
