CONSTITUTING THE METROPOLITAN MANILA AUTHORITY PROVIDING FOR ITS POWERS AND FUNCTIONS AND FOR OTHER PURPOSES
WHEREAS, pursuant to Presidential Decree No. 824, as amended, a public corporation known as Metropolitan Manila was formed from among the Cities of Manila, Quezon, Pasay, and Caloocan and the Municipalities of Makati, Mandaluyong, San Juan, Las Piñas, Malabon, Navotas, Pasig, Pateros, Parañaque, Marikina, Muntinlupa, Taguig, and Valenzuela, and placed under the administration of the Metropolitan Manila Commission;
WHEREAS, the President exercises direct supervision and control over the Metropolitan Manila Commission (Section 13, Presidential Decree No. 824, as amended);
WHEREAS, Article X, Sections 11 and 13 of the Constitution provide that:
"Sec. 11. The Congress may, by law, create special metropolitan political subdivisions, subject to the plebiscite as set forth in Section 10 hereof. The component cities and municipalities shall retain their basic autonomy and shall be entitled to their own local executives and legislative assemblies. Constituting the Metropolitan Manila Authority Providing For Its Powers and Functions and For Other Purposes
Executive Order No. 392
Summary of Executive Order No. 392:
Constitutes the Metropolitan Manila Authority (the Authority) composed of the heads of the 4 cities and 13 municipalities comprising Metropolitan Manila.
• The Authority has jurisdiction over the delivery of basic urban services requiring coordination in Metropolitan Manila. (Section 1)
• Basic urban services include: land use planning and zoning, traffic management, public safety, urban development and renewal, management and control during calamities and emergencies, and sanitation and waste management. (Section 1)
Establishes the Metropolitan Manila Council (the Council) composed of the Mayors of the 4 cities and 13 municipalities.
• The Council is governed by a Chairman elected from among the Mayor members for a 6-month term. (Section 2)
• The Council is assisted by a Metropolitan General Manager and 3 Deputy General Managers appointed by the President. (Section 2)
• The Council is responsible for formulating policies on basic service delivery, promulgating resolutions and issuances, approving a code of basic services, and exercising rule-making powers. (Section 2)
The Metropolitan Manila Commission devolves its powers and functions to the Authority, except those inconsistent with the Constitution and existing laws. (Section 3)
Functions of the Chairman of the Council:
• Call and preside over Council meetings. (Section 4.1)
• Present the annual budget for Council approval. (Section 4.2)
• Submit the organizational structure and staffing pattern for approval. (Section 4.3)
• Present plans, policies, programs, revenue measures, rules and regulations for Council approval after consultation. (Section 4.4)
• Prepare and submit annual reports and program evaluations. (Section 4.5)
• Recommend measures to improve quality of life or introduce new services. (Section 4.6)
• Recommend implementation of plans and programs to national policy bodies. (Section 4.7)
• Perform other functions required by law, the President, or the Council. (Section 4.8)
Functions of the Metropolitan General Manager:
• Manage day-to-day operations of the Authority. (Section 5.1)
• Develop programs and implement projects along Council policies. (Section 5.2)
• Act as head of the technical, consultative and management staff. (Section 5.3)
• Assist in preparing rules, plans, measures, and the basic services code. (Section 5.4)
• Prepare annual reports and other reports for the Chairman's approval. (Section 5.5)
• Perform other functions required by law, the Council, or the Chairman. (Section 5.6)
Local government units remain responsible for administering their jurisdictions, while the Authority attends to metropolitan-wide or common problems. (Section 6)
The Authority submits its annual operating budget to the Department of Budget and Management for inclusion in the general appropriations law. (Section 7)
City and municipal treasurers collect revenues accruing to the former Metropolitan Manila Commission and remit them as a trust fund to the Authority within 30 days after each month. Failure to remit on time is subject to penalties. (Section 7)
The President appoints city and municipal treasurers, assessors, and assistants upon the Council's recommendation and subject to civil service laws. (Section 8)
The Authority, Council, Chairman, and Metropolitan Manager are under the President's direct supervision, who can revoke, amend or modify their rules, resolutions or acts. The President retains administrative disciplinary jurisdiction over elective city and municipal officials. (Section 9)
The Authority conducts a periodic review of its functions, structure and program impact at least once a year and submits a report to the President. (Section 10)
Incumbent officials and employees of the former Metropolitan Manila Commission continue their duties under the Authority until changes are made. The Authority is exempted from the Local Government Code until provided by law. (Section 11)
Assets, properties, obligations, indebtedness and liabilities of the former Metropolitan Manila Commission are transferred to the Authority subject to conditions set by DBM, OP and COA. Civil service laws on displaced personnel are enforced. (Section 11)
The Acting Governor of Metropolitan Manila supervises the transfer of powers, functions, properties, assets, liabilities and personnel to the Authority within 60 days. After the Chairman's election within 60 days, the Acting Governor turns over affairs to the Council. (Section 12)
