CONVERTING THE PRESIDENTIAL COMMISSION ON REORGANIZATION INTO A PRESIDENTIAL COMMISSION ON GOVERNMENT REORGANIZATION, RECONSTITUTING ITS MEMBERSHIP, AND FOR OTHER PURPOSES.
WHEREAS, there is a need to effect the necessary and proper changes in the organizational and functional structures of the national and local governments, its agencies and instrumentalities, including government-owned and controlled corporations and their subsidiaries, in order to promote economy, efficiency and effectiveness in the delivery of public services;
WHEREAS, these major changes in the government bureaucracy must be responsive to and be consistent with the national goals for an accelerated socio-economic recovery and progress; and
WHEREAS, it is desirable to provide the President with adequate technical and staff support in the continuing assessment and determination of needed restructing of government in order to attain the aforesaid national goals.

Executive Order No. 5
CONVERTING THE PRESIDENTIAL COMMISSION ON REORGANIZATION INTO A PRESIDENTIAL COMMISSION ON GOVERNMENT REORGANIZATION, RECONSTITUTING ITS MEMBERSHIP, AND FOR OTHER PURPOSES
- Converts the Presidential Commission on Reorganization (PCR) into the Presidential Commission on Government Reorganization (PCGR) (Sec. 1)
- Reconstitutes the membership of the PCGR with the following:
- Hon. Luis R. Villafuerte as Chairman (with the rank of Minister and Cabinet member)
- Hon. Joker P. Arroyo as Member
- Hon. Teodoro Locsin, Jr. as Member
- Hon. Jaime Ferrer as Member (Sec. 1)
- Expands the functional jurisdiction of the PCGR to encompass the reorganization of the national and local governments, agencies, instrumentalities, government-owned or controlled corporations, and their subsidiaries (Sec. 2)
- Mandates the PCGR to provide staff assistance and consultative advice to the President, ministries, and other agencies on development administration, reorganization, decentralization, regionalization, career executive service, and rationalization of government corporation management and functions (Sec. 2)
- Requires the PCGR to assess, evolve, and define the functional relationships between the national government and its political subdivisions at various levels (Sec. 2)
- Abolishes the Special Presidential Reorganization Committee and transfers its functions and responsibilities, including the government corporation sector study, to the PCGR (Sec. 2)
- Mandates that all reorganization measures or proposals be submitted to and approved by the PCGR before submission to the President (Sec. 3)
- Requires all ministries and equivalent agencies to submit their reorganizational proposals to the PCGR by March 30 of the same year, including internal reorganization measures down to bureau and service levels, and transfer of functions between ministries (Sec. 4)
- Authorizes the PCGR to require ministries, bureaus, agencies, government-owned and controlled corporations, and local governments to submit studies, records, and other documents necessary for the performance of its functions and responsibilities (Sec. 4)
- Authorizes the PCGR to secure the services of personnel from other government agencies on temporary detail, either full-time or part-time (Sec. 5)
- Allows the PCGR to operate and transact its affairs under the name of the PCR until the necessary documentation for its formal operation under the PCGR name is completed, especially with respect to its budget, disbursements, and other financial and related transactions (Sec. 6)
- Authorizes the release of TEN MILLION PESOS (P10,000,000.00) to the PCGR, subject to the availability of funds, chargeable against the Special Activities Fund and/or any applicable appropriation's item provided for in Batas Pambansa Blg. 879 (Sec. 7)
- Declares the PCGR as a critical agency and exempts its personnel from the rules and regulations of the Office of Compensation and Position Classification, allowing the PCGR to determine the salary rates of its regular and contractual personnel, as well as the rates of honorarium of detailed personnel (Sec. 8)
- Repeals or modifies all laws, decrees, rules, regulations, and other issuances or parts thereof that are contrary to or inconsistent with this Executive Order (Sec. 9)
- Declares that this Executive Order shall take effect immediately (Sec. 10)
