EXECUTIVE ORDER No. 140

CREATING A CUSTOMS POLICY RESEARCH OFFICE (CPRO) IN THE DEPARTMENT OF FINANCE (DOF)

WHEREAS, the present Administration is committed to increase the tax effort of the revenue generating agencies of the government from the current 12.9 percent of Gross Domestic Product (GDP) to 16 percent by 2016;

WHEREAS, Executive Order (EO) No. 292, otherwise known as the “Administrative Code of 1987,” provides that the President has continuing authority to reorganize the Executive Department, allocate powers, functions and responsibilities, align resources, and provide clear direction to specific government agencies and units;

WHEREAS, under EO 292, DOF is responsible for the formulation, institutionalization and administration of fiscal policies and for the generation and management of the financial resources of the government;

WHEREAS, consistent with the above mandate, the DOF Secretary must spearhead efforts towards the streamlining of procedures and processes in revenue generating bureaus attached to DOF, one of which is the Bureau of Customs (BOC);

Summary of Executive Order No. 140

Creation of Customs Policy Research Office (CPRO)
- Section 1: Establishes the CPRO within the Department of Finance (DOF), responsible for reviewing customs policies and providing recommendations for improvement. The CPRO will be under the direct supervision of the DOF Secretary.

Powers and Functions of the CPRO
- Section 2(a): Review and evaluate existing customs rules, regulations, and international commitments, and recommend measures to:
    i. Simplify customs procedures while harmonizing with international practices (Section 2(a)(i))
    ii. Improve efficiency in customs services (Section 2(a)(ii))
    iii. Ensure proper collection, monitoring, and storage of data and records (Section 2(a)(iii))
    iv. Modernize the Bureau of Customs (BOC) systems and policies (Section 2(a)(iv))
    v. Promote seamless flow of goods while protecting local industries (Section 2(a)(v))
    vi. Maintain transparency, prevent corruption, and safeguard integrity in customs administration (Section 2(a)(vi))
    vii. Maximize BOC's revenue collection (Section 2(a)(vii))
- Section 2(b): Conduct research on modern regulatory practices on customs and tariff, and determine their applicability to the Philippine setting.
- Section 2(c): Draft customs reform bills and work with the legislative liaison office for shepherding them in Congress.
- Section 2(d): Formulate a framework for training modules for BOC personnel to ensure smooth transition to enhanced procedures and structures.
- Section 2(e): Recommend necessary actions to the DOF Secretary for implementation of proposals.

Personnel and Staffing
- Section 3: The CPRO will be composed of its organic personnel, as approved by the Department of Budget and Management (DBM) upon recommendation of the DOF Secretary, augmented by DOF, BOC, and other agency personnel. The CPRO may also hire technical consultants upon approval of the DOF Secretary.

Rules and Regulations
- Section 4: The DOF Secretary is authorized to promulgate rules and regulations, and prescribe procedures and processes to enable the CPRO to exercise its powers and discharge its duties.

Performance Audit System
- Section 5: The CPRO shall develop a performance audit system to monitor and measure actual performance of CPRO personnel as a basis for rewards, incentives, and punishment for nonfeasance or malfeasance, subject to existing laws and regulations. The DOF Secretary shall develop appropriate performance standards and a personnel evaluation system for the CPRO.

Funding
- Section 6: Funds shall be sourced proportionately from the savings of the concerned departments, agencies, bureaus, and offices as identified by DBM, subject to government accounting and auditing rules and regulations. The DOF Secretary shall submit a proposed budget to DBM.

Separability Clause
- Section 7: If any provision is declared invalid or unconstitutional, the other provisions shall remain valid and subsisting.

Repeal Clause
- Section 8: All orders, issuances, proclamations, rules, regulations, or parts thereof, which are inconsistent with this Order are hereby repealed or modified accordingly.

Effectivity
- Section 9: This Order shall take effect immediately upon publication in two (2) newspapers of general circulation.
