CREATING AN ENERGY DEVELOPMENT BOARD, DEFINING ITS POWERS AND FUNCTIONS, PROVIDING FUNDS, THEREFOR, AND FOR OTHER PURPOSES
WHEREAS, there is need to intensify, strengthen, and consolidate government efforts relating to the exploration, exploitation and development of indigenous energy resources vital to economic growth;
WHEREAS, it is imperative that government accelerate the pace of, and focus special attention on, energy exploration, exploitation and development in the light of encouraging results in recent oil exploration and of world-wide developments affecting our continued industrial progress and well-being; and
WHEREAS, it is essential in the interest of efficiency, economy, and effectiveness to integrate and coordinate through a single governmental entity the functions of various agencies pertaining to the exploration and development of indigenous extracted resources.

Summary of Presidential Decree No. 910
Declaration of Policy (Section 1)
- The State aims to achieve self-reliance in the country's energy requirements through the intensified and coordinated exploration, exploitation, and development of indigenous energy resources to accelerate overall economic growth.
Creation of the Energy Development Board (Section 2)
- An Energy Development Board is created, composed of the Secretaries of Finance, Industry, Justice, National Defense, Economic Planning, Natural Resources, and the Chairman of the Philippine National Oil Company.
- The President of the Philippines designates the Chairman of the Board from among its members.
- Alternate members are designated to attend meetings when principals are absent or positions are vacant.
Powers and Functions of the Board (Section 3)
- Formulate policies and implement/coordinate all government activities related to the exploration, exploitation, development, and extraction of energy resources including fossil fuels, geothermal resources, nuclear fuel resources, and other forms of indigenous energy resources. (Section 3a)
- Establish and administer a comprehensive program for the exploration, exploitation, development, and extraction of fossil and nuclear fuels, geothermal resources, and other forms of indigenous extracted energy resources. (Section 3b)
- Undertake by itself or through service contracts the active exploration, exploitation, development, and extraction of energy resources in selected areas and/or government reservations. (Section 3c)
- Regulate all activities related to the exploration, exploitation, development, and extraction of fossil and nuclear fuels and geothermal resources, and prescribe and collect fees for such regulation. (Section 3d)
- Assess, review, and provide direction to energy research and development programs, including identifying energy sources and determining their commercial feasibility for development. (Section 3e)
- Exercise the powers and functions of the abolished Petroleum Board transferred to the Board. (Section 3f)
- Coordinate, review, and approve plans and programs of the Power Development Council, which is attached to the Board. (Section 3g)
- Promulgate rules and regulations necessary to implement the objectives and provisions of this Decree. (Section 3h)
- Exercise all powers necessary or incidental to attain the objectives of this Decree. (Section 3i)
Officials and Employees of the Board (Section 4)
- The Board is assisted by an Executive Director appointed by the Board.
- The Board can appoint officers and employees, fix their compensation and benefits, grant leaves of absence, discipline and/or remove for cause, and establish a recruitment and merit system.
Abolition of the Petroleum Board (Section 5)
- The Petroleum Board is abolished, and its powers, functions, applicable funds, appropriations, records, equipment, property, and necessary personnel are transferred to the Board.
Transfer of Functions from the Bureau of Mines and/or the Department of Natural Resources (Section 6)
- The powers and functions of the Bureau of Mines and/or the Department of Natural Resources related to the exploration, development, and administration of coal-bearing lands, as well as the promotion and regulation of the exploration, exploitation, and development of geothermal energy, natural gas, and methane gas, are transferred to the Board, including applicable records, equipment, property, funds, appropriations, and necessary personnel.
Philippine National Petroleum Center (Section 7)
- The Philippine National Petroleum Center is under the supervision and control of the Board.
Appropriations (Section 8)
- Five Million Pesos is appropriated from the National Treasury for the organization and initial operations of the Board.
- Funds sufficient to carry out the functions and objectives of the Board shall be appropriated every fiscal year in the General Appropriations Act.
- All fees, revenues, and receipts of the Board from any sources, including service contracts and agreements, fines and penalties under the Petroleum Act of 1949, and the government share representing royalties, rentals, production share on service contracts, and similar payments on the exploration, development, and exploitation of energy resources, shall form part of a Special Fund to finance energy resource development and exploitation programs and projects of the government and for other purposes as directed by the President.
Reports (Section 9)
- The Board shall submit an annual report to the President within three months after the end of every fiscal year, including an energy development plan for the exploration, exploitation, development, and extraction of indigenous extracted energy resources, as well as periodic or other reports as required.
Separability Clause (Section 10)
- If any provision of this Decree is held unconstitutional, no other provision shall be affected.
Repealing Clause (Section 11)
- All laws, decrees, executive orders, administrative orders, rules, or regulations inconsistent with this Decree are repealed, amended, or modified accordingly.
Effectivity (Section 12)
- This Decree takes effect immediately.
