EXECUTIVE ORDER No. 139
CREATING AN OFFICE OF THE REVENUE AGENCY MODERNIZATION (ORAM) IN THE DEPARTMENT OF FINANCE (DOF)
WHEREAS, the present Administration is committed to increase the tax effort of the revenue generating agencies of the government from the current 12.9 percent of Gross Domestic Product (GDP) to 16 percent by 2016;
WHEREAS, Executive Order (EO) No. 292, otherwise known as the “Administrative Code of 1987,” provides that the President has continuing authority to reorganize the Executive Department, allocate powers, functions and responsibilities, align resources, and provide clear direction to specific government agencies and units;
WHEREAS, under EO 292, the Department of Finance (DOF) is responsible for the formulation, institutionalization and administration of fiscal policies and for the generation and management of the financial resources of the government;

Summary of Executive Order No. 139
Creation of the Office of Revenue Agency Modernization (ORAM)
- Section 1: ORAM is created within the Department of Finance (DOF) to formulate and implement improvements in processes, systems and procedures of revenue generating agencies to meet global best practices and standards.
- Section 1: ORAM is under the direct supervision and control of the DOF Secretary.
Powers and Functions of ORAM
- Section 2: Review and evaluate implementation of current administrative systems in revenue generating agencies and propose improvements.
- Section 2: Formulate and implement modern systems, procedures, and organizational structures to address urgent needs of revenue generating agencies.
- Section 2: Formulate a Code of Ethics for personnel of revenue generating agencies and develop enforcement mechanisms.
- Section 2: Recommend necessary actions to the DOF Secretary for implementation of proposals.
- Section 2: Perform all necessary and lawful acts for successful implementation.
Personnel and Staffing of ORAM
- Section 3: ORAM will have organic personnel approved by the Department of Budget and Management (DBM) upon recommendation of the DOF Secretary.
- Section 3: ORAM will be augmented by personnel from DOF, Bureau of Internal Revenue (BIR), Bureau of Customs (BOC), and other agencies.
- Section 3: ORAM may hire or engage technical consultants upon approval of the DOF Secretary.
Rules and Regulations
- Section 4: The DOF Secretary is authorized to issue rules, regulations, procedures and processes to enable ORAM to exercise its powers and functions.
Performance Audit System
- Section 5: ORAM shall develop a performance audit system to monitor and measure actual performance of personnel as a basis for rewards, incentives, and punishment.
- Section 5: The DOF Secretary shall develop performance standards and evaluation system for ORAM personnel.
Funding
- Section 6: Funds shall be sourced proportionately from savings of concerned departments, agencies, bureaus and offices as identified by DBM.
- Section 6: The DOF Secretary shall submit a proposed budget to DBM.
Separability Clause
- Section 7: If any provision is declared invalid or unconstitutional, the other provisions shall remain valid.
Repeal Clause
- Section 8: All orders, issuances, proclamations, rules, regulations inconsistent with this Order are repealed or modified accordingly.
Effectivity
- Section 9: This Order shall take effect immediately upon publication in two newspapers of general circulation.
