PRESIDENTIAL DECREE No. 342 November 22, 1973

CREATING AND ESTABLISHING THE PHILIPPINE CENTER FOR ADVANCED STUDIES AT THE UNIVERSITY OF THE PHILIPPINES; DEFINING ITS ORGANIZATION, POWERS, FUNCTIONS AND RESPONSIBILITIES

WHEREAS, there is need for total involvement of all sectors of society in the reform and development of Philippine culture and society;

WHEREAS, national development is a complex process requiring the concerted efforts of all sectors of society especially the expertise and competence of specialists in all fields of endeavors;

WHEREAS, one of the goals of the New Society is for the Philippines to take a more active role in international affairs and thereby derive benefits for the country therefrom;

WHEREAS, there is need to mobilize all institutions of higher learning especially state institutions, as full partners of government in order to (1) bring together specialists from various disciplines to conduct systematic research at fundamental levels; (2) assist the central government in the formulation of policies and programs; (3) address themselves to the examination of...

Summary of Presidential Decree No. 342

Establishment of the Philippine Center for Advanced Studies (PCAS)
- PCAS is established at the University of the Philippines, absorbing the present Asian Center. (Section 1)
- PCAS consists of the following Institutes and Divisions: (Section 2)
    - Institute of Islamic Studies
    - Institute of Philippine Studies
    - Institute of Asian Studies
    - Institute of Strategic Studies
    - Division of Basic Research
    - Division of Advanced Projects
    - Division of Academic Instruction

Organizational Structure and Administration
- PCAS is an autonomous unit of the University of the Philippines system. (Section 3)
- A Board of Trustees formulates objectives, policies, and nominates officers and staff. (Section 3(a))
    - The Board has 7 members: Executive Secretary, Secretary of National Defense, Secretary of Foreign Affairs, Secretary of Education and Culture, President of the University of the Philippines, Chancellor and Vice Chancellor of PCAS.
- PCAS is headed by a Chancellor responsible for leadership, management, and functioning. (Section 3(b))
- Administrative officers include Chancellor, Vice Chancellor, Secretary, Directors of the three Institutes, and Chairmen of the three Divisions. (Section 3(c))

Functions and Powers of PCAS
- PCAS has the following functions and powers: (Section 5)
    - To adopt, alter, and use a corporate seal.
    - To take and hold property by bequest, devise, gift, purchase, or lease, and to invest and reinvest funds. (Section 5(b))
    - To collect, receive and maintain funds, and apply them to promote its aims and purposes. (Section 5(c))
    - To contract obligations or enter into agreements necessary for proper management. (Section 5(d))
    - To carry on any activity and exercise all powers of government-owned or controlled corporations.

Funding and Financial Provisions
- Funds currently appropriated to the Asian Center shall be incorporated into the PCAS budget. (Section 6)
- The University of the Philippines is directed to appropriate 1.5 million pesos each fiscal year beginning June 1974 for PCAS operational expenditures. (Section 6)
- A PCAS endowment fund of 20 million pesos from unappropriated National Treasury funds and an additional 5 million pesos is created for non-recurring expenditures. (Section 7)
    - The endowment fund principal shall not be impaired, and only the earnings shall be available for expenditure.
- PCAS expenditures and disbursements are not subject to procurement requirements and restrictions imposed on government agencies. (Section 8)
- Any savings of PCAS shall constitute a revolving fund and shall not revert to the General Fund. (Section 10)

Staffing and Personnel Provisions
- Appointments to the teaching, research and administrative staff of PCAS may be on a part-time basis. (Section 9)
- PCAS staff are exempt from the Civil Service Law, position classification, salary standardization, and Section 259 of the Revised Administrative Code. (Section 9)
    - Government retirees employed at PCAS shall not be required to refund gratuity or have pension/annuity suspended or reduced.
- PCAS may obtain services of scholars and technical personnel from any Philippine government agency, including other University of the Philippines units, and provide them honorarium. (Section 11)
