CREATING MARITIME ATTACHE POSTS IN THE FOREIGN SERVICE
WHEREAS, it is declared policy of the Philippine government to promote, expand and modernize the Philippine merchant fleet;
WHEREAS, in the overseas shipping sector, the competitiveness of the national fleet as well as the training and welfare of Filipino seamen abroad dictate the need for readily accessible and available government assistance.
WHEREAS, creation of maritime posts in the principal shipping centers of the world would greatly provide such needed assistance; and
WHEREAS, under Presidential Decree No. 1416, the President is empowered to undertake such organizational and related improvements as maybe appropriate in the light of changing circumstances and new developments.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, and the authority vested in me by Presidential Decree No. 1416, do hereby order and ordain:

Creating Maritime Attache Posts in the Foreign Service
- Declares the policy of promoting, expanding, and modernizing the Philippine merchant fleet. (Preamble)
- Recognizes the need for government assistance to the national fleet, training, and welfare of Filipino seamen abroad. (Preamble)
- Creates Maritime Attache positions under the Maritime Industry Authority to serve in diplomatic missions or consular offices abroad, appointed by the President upon recommendation of the Maritime Industry Authority Administrator. (Section 1)
Functions of Maritime Attaches: (Section 2)
- Provide advice and assistance on vital shipping policies, development, and legislations in other countries. (Section 2a)
- Represent the Maritime Industry Authority and other agencies in international conventions and conferences on maritime matters, and assist in formulating Philippine positions. (Section 2b)
- Advise and assist in negotiating bilateral maritime agreements. (Section 2c)
- Coordinate, evaluate, and recommend technical assistance on maritime training. (Section 2d)
- Advise and assist in determining reasonable price, charter hire levels, and technical information for ship acquisitions and chartering. (Section 2e)
- Act as the implementing arm of the Freight Booking and Cargo Consolidation Center of the Philippine Shippers Council in issuing waivers for sea transport of exports and imports covered under P.D. No. 1466 by Philippine Flag vessels when unavailable or under exempting conditions. (Section 2f)
- Act as the designated agent of the Philippine Coast Guard in endorsing and registering preferred ship mortgages under P.D. No. 1521. (Section 2g)
- Act as the deputized agent of the Philippine Coast Guard in vessel registration, licensing, documentation, and fee collection for ocean-going vessels, and coordinate with classification societies for SOLAS Certificate issuance. (Section 2h)
- Advise and assist the National Seamen Board in providing seamen welfare services abroad, in coordination with the labor attache. (Section 2i)
- Advise and assist the Professional Regulation Commission in holding professional examinations for marine officers abroad, upon request. (Section 2j)
- Advise and assist the Central Bank, Securities and Exchange Commission, Board of Investments, Bureau of Customs, and other agencies in vessel acquisition valuation, upon request. (Section 2k)
- Submit monthly activity reports to the Maritime Industry Authority. (Section 2l)
- Perform other functions necessary to carry out the provisions and interests of this Executive Order. (Section 2m)
- The Maritime Industry Authority Administrator shall coordinate with relevant agencies in formulating implementing guidelines, staffing pattern, and compensation for the maritime attache positions. (Section 3)
- The Minister of the Budget is directed to provide funds for Calendar Years 1980 and 1981, and the positions shall be included in regular annual appropriations thereafter. (Section 3)
- The Authority may recommend designating maritime attaches from personnel of other pertinent government entities, such as the Philippine Coast Guard, subject to existing laws, rules, and regulations. (Section 4)
- All conflicting laws, decrees, executive orders, administrative orders, proclamations, rules, and regulations are repealed or modified accordingly. (Section 5)
- The Executive Order takes effect immediately. (Section 6)
