CREATING THE EXPERIMENTAL CINEMA OF THE PHILIPPINES
WHEREAS, the motion picture is one of the popular media of expression in modern times which serves as a vital instrument in the promotion of social, cultural and economic progress;
WHEREAS, the recent film festival has been acclaimed as a tremendous success by local and foreign sectors of the film industry;
WHEREAS, the film festival has demonstrated that there is a need for improvement in the local film industry;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order as follows:
Sec. 1. Creation of the Experimental Cinema of the Philippines. There is hereby created a corporation to be known as the Experimental Cinema of the Philippines, attached to the Ministry of Tourism, hereinafter referred to as the Cinema.

EXECUTIVE ORDER NO. 770
Creation of the Experimental Cinema of the Philippines (Sec. 1)
- A corporation called the Experimental Cinema of the Philippines is created, attached to the Ministry of Tourism.
Powers and Functions of the Cinema (Sec. 2)
- Engage in activities to promote the growth and development of the film industry. (Sec. 2.1)
- Produce or import films for exhibition at the Film Center established under Executive Order No. 640-A. (Sec. 2.2)
- Manage and operate the Film Center under arrangement with the Cultural Center of the Philippines. (Sec. 2.3)
- Coordinate with the Filipino Motion Pictures Development Board on matters affecting the film industry. (Sec. 2.4)
- Establish and maintain a special fund to provide financial assistance to motion picture projects. (Sec. 2.5)
- Formulate and administer a national film rating and classification system, subject to the President's approval. (Sec. 2.6)
- Establish, operate and maintain a Film Archive for preserving and disseminating motion pictures. (Sec. 2.7)
- Assist Filipino talents in acquiring skills and expertise for quality film production. (Sec. 2.8)
- Borrow funds, acquire and manage real and personal property necessary for the Cinema's purposes. (Sec. 2.9)
- Invest funds and assets in activities or undertakings deemed wise or desirable. (Sec. 2.10)
- Establish, organize, operate and maintain international film festivals, exhibitions and similar activities. (Sec. 2.11)
- Construct and maintain buildings and facilities such as theaters, screening rooms and similar facilities. (Sec. 2.12)
- Perform other functions authorized by law or the President of the Philippines. (Sec. 2.13)
Freedom from Censorship (Sec. 3)
- All films produced or imported by the Cinema for exhibition at the Film Center shall be free from censorship.
Board of Trustees (Sec. 4)
- The Cinema's operations shall be managed by a Board of Trustees composed of three members: the Minister of Tourism or representative, a Chairman, and one member appointed by the President.
Responsibilities of the Board (Sec. 5)
- Prepare and adopt necessary rules and regulations. (Sec. 5.1)
- Prepare and approve the Cinema's budget. (Sec. 5.2)
- Review periodically the administration and programs of the Cinema. (Sec. 5.3)
- Perform other functions authorized by law. (Sec. 5.4)
Director-General (Sec. 6)
- The Chief Executive Officer of the Cinema shall be the Director-General, appointed by the President.
- The Director-General shall be the Chairman of the Board and receive compensation fixed by the Board.
- Powers and duties of the Director-General are specified in Sec. 6 (a) to (g).
Deputy Director-General (Sec. 7)
- The Deputy Director-General shall be appointed by the President and receive compensation fixed by the Board.
- Assist the Director-General in implementing policies and supervising operations.
Staff Appointments (Sec. 8)
- The Cinema shall appoint and maintain an adequate technical and administrative staff in accordance with laws and rules governing government corporations.
Authority to Receive Donations and Other Powers (Sec. 9)
- The Cinema shall have the authority to receive donations from domestic and foreign sources.
- The Cinema may exercise all the powers and prerogatives of a private corporation under the Corporate Code of the Philippines.
Exemption from Taxes (Sec. 10)
- Any donation, contribution, subsidy or financial aid made to the Cinema shall be exempt from taxes and constitute allowable deductions for income tax purposes.
- The Cinema, its assets, acquisitions, income, operations and transactions shall be exempt from any taxes, fees, charges, imports, licenses and assessments imposed by the government or its political subdivisions.
Appropriation (Sec. 11)
- Three million pesos is appropriated from the Special Activities Fund for the initial operation of the Cinema.
- Additional amounts needed for operation shall be included in the General Appropriations Act.
Disposition of Assets upon Dissolution (Sec. 12)
- In the event of dissolution, the Cinema's remaining assets after payment of liabilities shall be disposed of and turned over to a foundation or institution with the same or similar pursuits, or to the Republic of the Philippines or its agencies or instrumentalities as decided by the Board of Trustees.
Repealing Clause (Sec. 13)
- Provisions of Executive Order No. 640-A and other laws, decrees, orders or regulations inconsistent with this Order are repealed, amended or modified accordingly.
Effectivity (Sec. 14)
- This Order shall take effect immediately.
