EXECUTIVE ORDER No. 469
CREATING THE MINERALS DEVELOPMENT COUNCIL, DEFINING ITS POWERS AND FUNCTIONS
WHEREAS, Sec. 2 Art. XII of the Constitution provides that the State owns, and has full control and supervision over all natural resources;
WHEREAS, to be more effective in the development and utilization of natural resources, there is a need to mobilize the entire government bureaucracy to support, enhance and strengthen the operations and programs relative to minerals development;
WHEREAS, under Section 31, Chapter 10, Title III, Book II of the Administrative Code of 1987, the President has the continuing authority to reorganize the administrative structure of the Office of the President;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Summary of Executive Order No. 469
Creation of the Minerals Development Council (MDC)
- Section 1: The MDC is created under the Office of the President to advance the government policy of responsible and sustainable development of the State's minerals resources.
Composition of the MDC
- Section 2: The MDC is composed of the following members:
• Department of Environment and Natural Resources (DENR) - Chairman
• Presidential Adviser for Multilateral Development - Vice Chairman
• Other government agencies and the Chamber of Mines of the Philippines as members
• An Executive Director with the rank of Undersecretary, appointed by the President, to manage the day-to-day affairs of the MDC.
Powers and Functions of the MDC
- Section 3:
• Enlist assistance from government agencies to implement minerals development programs, harmonize investment requirements, and facilitate investments in the minerals sector. (Section 3a)
• Assist investors in the minerals sector by providing information, guidance, and solutions. (Section 3b)
• Facilitate tasks and reporting related to the Minerals Action Plan from E.O. 270 s. 2004. (Section 3c)
• Review aspects related to investments in the mineral industry, recommend measures, address issues, and monitor implementation of minerals development programs. (Section 3d)
• Advise the President on solutions to problems impeding investments in the minerals industry. (Section 3e)
• Promote investments in the minerals industry, including organizing investment events. (Section 3f)
• Prepare and submit reports to the President on the status of investments in the minerals industry. (Section 3g)
• Create Regional Mineral Development Councils in key regions with priority mineral development projects. (Section 3h)
• Perform other functions as directed by the President. (Section 3i)
Funding
- Section 4: Initial funding from sources identified by the Department of Budget and Management (DBM). Subsequent appropriations to be incorporated in the budget proposal of the Office of the President.
Implementing Guidelines
- Section 5: The MDC shall adopt operating guidelines to implement and achieve the objectives of this Order.
Repealing Clause
- Section 6: All orders, rules, regulations, and issuances inconsistent with this Executive Order are repealed or modified accordingly.
Effectivity
- Section 7: This Executive Order shall take effect immediately.
