CREATING THE PHILIPPINE FISH MARKETING AUTHORITY, DEFINING ITS FUNCTIONS AND POWERS, AND FOR OTHER PURPOSES
WHEREAS, it is recognized that fish is a staple food and major source of protein of the Filipino people;
WHEREAS, there is an imperative need to increase fish supply and stabilize consumer prices through the improvement of handling and marketing practices in fish landings and fish markets throughout the country, particularly in major centers of population;
WHEREAS, Filipino and foreign marketing experts are unanimous in their observation that there is a need for a more organized marketing and distribution system for fish that would coordinate the interests of fishing boat operators, fishpond and fishpen owners, brokers, wholesaler, retailers and consumers; and
WHEREAS, it is necessary to provide a modern organizational and marketing framework to supplement current and future development programs in the fishing industry.

Creating The Philippine Fish Marketing Authority, Defining Its Functions And Powers, And For Other Purposes
Presidential Decree No. 977
Declaration of Policy (Section 1)
- Promote development of fishing industry
- Improve efficiency in handling, preserving, marketing and distribution of fish and fishery/aquatic products
- Establish and operate fish markets, fishing ports, harbors and other marketing facilities
Creation of Philippine Fish Marketing Authority (Section 2)
- Under control and supervision of Secretary of Natural Resources
Principal Office (Section 3)
- Establish principal office in Metro Manila area
- Establish branches and agencies within Philippines as necessary
Functions and Powers of the Authority (Section 4)
- Manage, administer, operate, improve and modernize fishing ports, markets, landings and related facilities (Section 4a)
- Prepare and implement comprehensive plan for development of fishing port and market complexes (Section 4a)
- Construct infrastructure facilities, factory buildings, warehouses, cold storage, ice plants and other structures related to fishing industry (Section 4a)
- Acquire, hold and dispose real and personal property (Section 4a)
- Provide market intelligence, information, advisory and promotional services to fishing industry (Section 4b)
- Determine, regulate, control and supervise operations within fish markets and facilities (Section 4c)
- Fix, assess, collect fees, tolls, charges, rentals for use of property, equipment, facilities and services (Section 4d)
- Contract indebtedness and issue bonds with approval (Section 4e)
- Promulgate rules on use of wharves, piers, anchorages by fishing boats and stevedoring/arrastre services (Section 4f)
- Have perpetual succession, adopt by-laws, use corporate seal, sue and be sued, enter into contracts, exercise corporate powers (Section 4g, 4h)
- Acquire, maintain, operate, purchase, dispose or lease vessels, fishing gears, refrigerated trucks, ice/cold storage plants, barges, fish plants, communication facilities, refrigerated trains and related facilities (Section 4i)
- Undertake marketing of fish and fishery/aquatic products for domestic consumption and export when required (Section 4j)
- Exercise right of eminent domain (Section 4k)

- Existing assets of Navotas Fish Landing and other property transferred from Bureau of Fisheries and Aquatic Resources and other agencies
- Cash contribution by the Government as approved by the President and incorporated in annual Appropriation Act

- Composed of Secretary of Natural Resources (Chairman), Secretary of Public Works, Transportation & Communications (Vice-Chairman), Secretary of Trade or representative, President of Food Terminal Inc. or representative, Director of Fisheries & Aquatic Resources, and two representatives of private fishery industry appointed by the President
Powers and Duties of the Board (Section 7)
- Adopt and amend by-laws (Section 7a)
- Promulgate policies, rules and regulations to implement the Decree and agreements (Section 7b)
- Approve annual and supplementary budgets (Section 7c)
- Assess and fix charges, tolls, fees and rentals (Section 7d)
- Organize, reorganize and determine staffing pattern, fix salaries and emoluments, appoint General Manager and Assistant General Manager (Section 7e)
- Approve contracts and agreements (Section 7f)
- Submit periodic and special reports to the President (Section 7g)
- Exercise all powers necessary to attain purposes of the Decree (Section 7h)

- Vested in General Manager appointed by Board of Directors

Powers, Functions and Duties of the General Manager (Section 9)
- Implement and enforce policies, programs, guidelines, standards, decisions, rules and regulations prescribed by the Board (Section 9a)
- Manage day-to-day affairs of the Authority (Section 9b)
- Undertake studies and researches to determine needs of fish markets and facilities and ensure operational efficiency (Section 9c)
- Determine staffing pattern, define duties and responsibilities, fix salaries and emoluments with Board approval (Section 9d)
- Appoint, dismiss, promote and transfer personnel below Assistant General Manager (Section 9e)
- Perform other duties necessary to implement the Decree (Section 9f)
- Submit periodic and special reports to the Board (Section 9g)
- Exercise all powers necessary to attain purposes of the Decree (Section 9h)
Non-profit Character and Tax Exemption (Section 10)
- Authority shall be non-profit
- Use returns from capital investment and excess revenues for development, improvement and maintenance of fish ports and related expenditures incorporated in Annual Budget
- Exempted from payment of income tax, but may be lifted by the President after 5 years if found self-sustaining and financially capable
Navotas Fishing Port and Fish Markets (Section 11)
- Navotas Fish Market and related facilities transferred to and placed under exclusive jurisdiction, control, administration and supervision of the Authority
- Other fish markets and facilities may be established by the Board with approval of the President
Repealing Clause (Section 12)
- All acts, executive orders, proclamations, administrative orders, rules and regulations inconsistent with the Decree are repealed
Effectivity (Section 13)
- The Decree shall take effect upon promulgation
