CREATING THE PRESIDENTIAL FACT-FINDING AND POLICY ADVISORY COMMISSION ON THE PROTECTION OF OVERSEAS FILIPINOS
WHEREAS, recent events have evoked the nation's serious concern for and recognition of overseas Filipinos;
WHEREAS, it is the policy of the Philippine Government to be firmly committed to the protection of overseas Filipinos;
WHEREAS, certain claims and assertions as well as accusations have been made against some officials of the Philippine Government in connection with its efforts to protect overseas Filipinos;
WHEREAS, there is a need to determine with utmost certainty the circumstances surrounding recent events involving the policies and actions of government in relation to the protection of overseas Filipinos; and
WHEREAS, much can be learned from instances in which such policies and actions of government have succeeded and from those which did not lead to the desired results.

Summary of Executive Order No. 231
Creation of Presidential Fact-Finding and Policy Advisory Commission on the Protection of Overseas Filipinos (Section 1):
- Commission to be created to determine facts and circumstances involving policies and actions of the Philippine Government in relation to the protection of overseas Filipinos.
- Commission to accomplish objectives within 3 months, unless otherwise ordered by the President.
Composition of the Commission (Section 2):
- Chairman: A retired Justice of the Supreme Court.
- 6 members appointed by the President:
- 2 members representing overseas contract workers and organized labor.
- 1 member representing employers.
- 1 member representing the Department of Social Welfare and Development.
- 1 member representing the National Commission on the Role of Filipino Women.
- 1 member representing the public-at-large.
Objectives of the Commission (Section 3):
- Determine facts and circumstances involving policies and actions of the Philippine Government in relation to the protection of overseas Filipinos, particularly cases involving criminal conviction of overseas Filipinos, including the case of Mrs. Flor Contemplacion. (Section 3.1)
- Make recommendations to improve the protection afforded by the Philippine Government to overseas Filipinos, consonant with international conventions and standards. (Section 3.2)
Mandate of the Commission (Section 4):
- Inquire into, examine and probe individual cases involving the protection of overseas Filipinos. (Section 4.1)
- Seek views and opinions of different sectors of Philippine society, including people's organizations, cooperatives, media, and other non-government organizations. (Section 4.2)
- Identify instances which may require filing of administrative and other charges against Philippine Government officials and private individuals, and recommend filing of such charges. (Section 4.3)
- Formulate recommendations, including legislative measures, for the improvement of the protection of overseas Filipinos by the Philippine Government. (Section 4.4)
- Submit a report on the Mrs. Flor Contemplacion case to the President within 15 days from the constitution of the Commission. (Section 4.5)
Powers and Functions of the Commission (Section 5):
- Call on any department, instrumentality or agency of the government for assistance and cooperation. (Section 5.1)
- Issue compulsory processes to private individuals, groups or organizations as well as government officials, in accordance with existing laws, regulations and procedures. (Section 5.2)
- Request cooperation of foreign governments through appropriate diplomatic channels and with due regard to diplomatic considerations. (Section 5.3)
- Promulgate its own administrative and procedural rules and regulations. (Section 5.4)
Secretariat and Technical Panel (Sections 6 and 7):
- Commission to be assisted by a Secretariat to provide administrative and office support, composed of persons appointed by the Chairman. (Section 6)
- A Technical Panel composed of experts in law, labor, social welfare, and other relevant fields to be appointed by the Chairman to provide technical assistance and advice to the Commission. (Section 7)
- Officials from relevant government agencies may be invited to serve as members of the Technical Panel. (Section 7)
Office and Funding (Sections 8 and 9):
- Commission to be provided with appropriate office space in coordination with government agencies and government-owned or controlled corporations. (Section 8)
- Initial funding of Five Million Pesos (P5,000,000.00) from the President's Contingent Fund to be provided for the operations of the Commission, without prejudice to the provision of additional funds. (Section 9)
