EXECUTIVE ORDER No. 104

DECLARING AND DELINEATING THE UBAY PORT ZONE AND PLACING IT UNDER THE ADMINISTRATIVE JURISDICTION OF THE PHILIPPINE PORTS AUTHORITY (PPA)

WHEREAS, the Port of Ubay in Ubay, Bohol is one of the major and busiest ports in the country; and

WHEREAS, there is a need to define the Port Zone of Ubay for the planning and development of the necessary port facilities thereat to support the demands of shipping trade within the region.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

SECTION 1. Port of Ubay. The territorial jurisdiction of the Port of Ubay situated in the Municipality of Ubay, Province of Bohol, is hereby delineated and established, particularly described as follows:

Beginning at a point marked 1 on the plan, thence:

Summary of Executive Order No. 104

Delineation of Ubay Port Zone
- The territorial jurisdiction of the Port of Ubay in Ubay, Bohol is delineated and established with specific boundaries and coordinates. (Section 1)
- The total area covered is 385,493.35 square meters. (Section 1)

Administrative Jurisdiction of PPA
- The Ubay Port Zone is placed under the administrative jurisdiction of the Philippine Ports Authority (PPA). (Section 2)
- The PPA shall implement a program for the proper zoning, planning, development, and utilization of the port, consistent with the regional industrial plans of the government. (Section 2)

Repeal and Separability Clauses
- All issuances, orders, rules, and regulations inconsistent with this Executive Order are repealed, amended, or modified accordingly. (Section 3)
- If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions not affected shall remain valid and subsisting. (Section 4)

Effectivity
- This Executive Order shall take effect immediately upon publication in a newspaper of general circulation. (Section 5)
