Executive Order No. 251

EXECUTIVE ORDER NO. 251 June 15, 1995

DECLARING THE ISLAND OF LUZON AS CALAMITY AREA AS A RESULT OF THE FOOT AND MOUTH DISEASE EPIDEMIC, RATIONALIZING PUBLIC SAFETY MEASURES FOR THE ERADICATION OF FOOT AND MOUTH DISEASE IN THE COUNTRY, AND APPROPRIATING FUNDS THEREFORE

WHEREAS, there has been a series of reports of outbreak of Foot and Mouth disease in the animal industry particularly on swine, cattle, and carabao in the entire Island of Luzon;

WHEREAS, the Secretary of Agriculture through a Technical Committee created to look into these reports have confirmed the presence of the said disease in the entire Island of Luzon;

WHEREAS, the Department of Agriculture has recognized that the alarming rate of the spread of the disease has reached epidemic proportions; further, that such s spread must be arrested and prevented from affecting the Visayas and Mindanao provinces, including Palawan, most of which are now declared FMD-free zones;

Summary of Executive Order No. 251

Declaring the Island of Luzon as Calamity Area due to Foot and Mouth Disease Epidemic
- The entire Island of Luzon is declared as a Calamity Area due to the Foot and Mouth Disease (FMD) epidemic. (Sec. 1)

Appropriation of Funds
- An initial amount of Twenty Million Pesos (P20,000,000.00) is released from the President's calamity fund for the initial implementation of this Order. (Sec. 2)
- Further fund releases from the calamity fund shall be allowed upon approval by the Office of the President. (Sec. 2)

Role of the Department of Agriculture and Bureau of Animal Industry
- The Department of Agriculture (DA), through the Bureau of Animal Industry (BAI), shall coordinate and supervise the following: (Sec. 3)
    - Implementation of necessary preventive and control measures
    - Monitoring of the presence of FMD
    - Procurement, distribution, and administration of vaccines to affected areas

Reporting and Assistance from Local Government Units
- All concerned agencies, including local government units, shall immediately report any occurrence of FMD to the BAI. (Sec. 4)
- They shall provide all necessary assistance to DA-BAI inspection teams operating within their jurisdiction. (Sec. 4)
- If a Local Government Unit is declared as an FMD-infected area, 10% of their Internal Revenue Allotment contingency fund shall be used for procuring vaccines, drugs, and/or biologicals necessary for FMD control. (Sec. 4)

Priority for Backyard Animal Raisers
- The DA and BAI shall give priority to backyard animal raisers in the distribution and administration of vaccines to affected animals. (Sec. 5)
- If possible, vaccines shall be given free of charge to backyard farmers/raisers. (Sec. 5)

Exemption from Taxes and Duties
- Procurement of necessary medicines, vaccines, and laboratory equipment, whether local or imported, for FMD eradication shall be exempted from payment of tariffs, customs duties, or any other applicable taxes. (Sec. 6)
- A certification from the BAI Director indicating that the items shall be used for FMD eradication is necessary. (Sec. 6)

Reporting to the President
- The Secretary of Agriculture shall submit monthly accomplishment reports to the President, stating the progress, further works, and recommendations. (Sec. 7)

Effectivity
- This Executive Order shall take effect immediately upon approval and shall remain in effect until FMD is officially declared as totally eradicated in the country by the DA-BAI. (Sec. 9)
