EXECUTIVE ORDER No. 434 June 3, 2005
DELEGATING TO THE SECRETARY OF EDUCATION THE POWER TO EXERCISE POLICY OVERSIGHT OVER THE COMMISSION ON HIGHER EDUCATION
WHEREAS, the Commission on Higher Education (Commission) was created under Republic Act No. 7722, approved on May 18, 1994, otherwise known as the "Higher Education Act of 1994";
WHEREAS, Section 3 thereof provide that "x x x The Commission shall be independent and separate from the Department of Education, Culture and Sports (DECS, now Department of Education (DepEd) and attached to the Office of the President for administrative purposes only.xxx";
WHEREAS, Executive power is vested in the President under Section I, Article VII of the Constitution and under Section ll, Chapter 3, Book ll of Executive Order No 292, otherwise known as the "Administrative Code of 1987";
WHEREAS, Section 17, Article Vll of the Constitution provides that the President shall have control of all executive departments, bureaus and offices and shall ensure that all laws be faithfully executed;

Executive Order No. 434
Delegation of Policy Oversight over the Commission on Higher Education (CHED) to the Secretary of Education
- The President delegates the power to exercise policy oversight over CHED to the Secretary of Education. (Section 1)
- This power is derived from the President's authority under Section 17, Article VII of the Constitution and as the administrative head of the Government.
- All other executive issuances, rules, and regulations inconsistent with this Executive Order are repealed, amended, or modified accordingly. (Section 2)
- This Executive Order takes effect immediately. (Section 3)
- The President delegates the power to exercise policy oversight over CHED to the Secretary of Education. (Section 1)
- This power is derived from the President's authority under Section 17, Article VII of the Constitution and as the administrative head of the Government.
- All other executive issuances, rules, and regulations inconsistent with this Executive Order are repealed, amended, or modified accordingly. (Section 2)
