EXECUTIVE ORDER NO. 84 December 10, 1986

DIRECTING THE NATIONAL HOUSING AUTHORITY TO SUSPEND THE COLLECTION OF AMORTIZATION ARREARAGES AND DELINQUENCY INTEREST CHARGES ON PAST DUE ACCOUNTS OF THE BENEFICIARIES OF SOCIAL HOUSING LOTS IN DESIGNATED PROJECTS AND TO GRANT A MORATORIUM ON THE EVICTION OF LEGAL OCCUPANTS/AWARDEES OF SOCIAL HOUSING LOTS WHO HAVE NOT APPROPRIATE SALES/LEASE CONTRACTS

WHEREAS, the government's priority concern is the welfare of marginal and low income families who are the intended beneficiaries of the National Shelter Program;

NOW THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

Sec. 1. The National Housing Authority shall suspend the collection of amortization arrearages and delinquency interests due and demandable as of December 31, 1986 from the beneficiaries of social residential lots in projects as may be determined by its General Manager and approved by its Board of Directors, taking into consideration the welfare of the marginal and low income families who are the intended beneficiaries of the National Shelter Program: Provided, That concerned beneficiary families...

Summary of Executive Order No. 84

Suspension of Collection of Amortization Arrearages and Delinquency Interest Charges
- The National Housing Authority (NHA) shall suspend the collection of amortization arrearages and delinquency interests due as of December 31, 1986 from beneficiaries of social residential lots in designated projects. (Sec. 1)
- Beneficiary families must pay in full their amortization payments for January 1987 on or before February 5, 1987 and maintain their accounts up-to-date thereafter. (Sec. 1)

Acknowledgment of Arrearages and Delinquency Interests
- To qualify, beneficiary families shall acknowledge their respective amortization arrearages and delinquency interests. (Sec. 2)
- If their accounts fall into arrears for at least three (3) consecutive months after the deferment, all arrearages shall become immediately due and demandable. (Sec. 2)

Extension of Repayment Periods
- The repayment periods specified in the original contract documents shall be extended by a period equivalent to the number of monthly payments that are past due as of December 31, 1986. (Sec. 3)

Moratorium on Eviction of Legal Occupants/Awardees
- The NHA shall grant a moratorium on the eviction of legal occupants/awardees of social residential lots who have not signed appropriate sale/lease contracts. (Sec. 4)
- All such beneficiary-families shall enter into legal contracts with the NHA on or before January 5, 1987. (Sec. 4)
- Any legal awardee who fails to enter into a contract within the prescribed time period shall be considered a squatter and shall be evicted. (Sec. 4)

Implementing Guidelines
- The NHA General Manager shall issue the implementing guidelines for this Executive Order. (Sec. 5)

Repeal or Modification of Inconsistent Laws
- All laws, orders, issuances, rules and regulations or parts thereof inconsistent with this Executive Order are hereby repealed or modified accordingly. (Sec. 6)

Effectivity
- This Executive Order shall take effect immediately. (Sec. 7)
