EXECUTIVE ORDER NO. 39 August 6, 1986
ENLARGING THE POWERS AND FUNCTIONS OF THE COMMISSIONER OF CUSTOMS
I, CORAZON C. AQUINO, President of the Philippines, do hereby order:
Sec. 1. In addition to the powers and functions of the Commissioner of Customs, he is hereby authorized, subject to the Civil Service Law and its implementing rules and regulations:
a) To appoint Bureau personnel, except those appointed by the President;
b) To discipline, suspend, dismiss or otherwise penalize erring Bureau officers and employees;
c) To act on all matters pertaining to promotion transfer, detail, reassignment, reinstatement, reemployment and other personal action, involving officers and employees of the Bureau of Customs.
Sec. 2. The Ministry of the Budget and Management and the Civil Service Commission shall extend full cooperation and assistance to the Commissioner of Customs in carrying out the provisions of this Executive Order.
Sec. All laws, orders, issuances, rules and regulations or parts thereof inconsistent with this Executive Order are hereby repealed or modified accordingly.

Enlarging the Powers and Functions of the Commissioner of Customs
- Authorizes the Commissioner of Customs to perform the following functions, subject to the Civil Service Law and its implementing rules and regulations (Sec. 1):
• Appoint Bureau personnel, except those appointed by the President. (Sec. 1a)
• Discipline, suspend, dismiss or otherwise penalize erring Bureau officers and employees. (Sec. 1b)
• Act on all matters pertaining to promotion, transfer, detail, reassignment, reinstatement, reemployment, and other personal actions involving officers and employees of the Bureau of Customs. (Sec. 1c)
- Requires the Ministry of the Budget and Management and the Civil Service Commission to extend full cooperation and assistance to the Commissioner of Customs in carrying out the provisions of this Executive Order. (Sec. 2)
- Repeals or modifies all laws, orders, issuances, rules, and regulations or parts thereof inconsistent with this Executive Order. (Sec. 3)
- Specifies that this Executive Order shall take effect immediately. (Sec. 4)
