PRESIDENTIAL DECREE No. 1497

ESTABLISHING A STATE UNIVERSITY IN THE PROVINCE OF PANGASINAN TO BE KNOWN AS THE PANGASINAN STATE UNIVERSITY BY TRANSFERRING ALL COLLEGE LEVEL COURSES OF THE STATE-SUPPORTED INSTITUTIONS OF HIGHER LEARNING THEREAT INTO SAID INSTITUTION/UNIVERSITY, PROVIDING A CHARTER FOR THIS PURPOSE, AND APPROPRIATING FUNDS THERETO

WHEREAS, the Constitution of the Philippines directs the State to establish and maintain a complete, adequate, and integrated system of education relevant to the goals of national development and further prescribes that all educational institutions shall aim to develop scientific, technological, and vocational efficiency;

WHEREAS, under Presidential Decree No. 6-A also known as the Educational Decree of 1972 promulgated on September 20, 1972, it has been declared a policy of the government to re-orient the educational system toward accelerated national economic growth and meaningful social development;

WHEREAS, to maximize the effective utilization of limited resources, it is necessary to integrate and convert the state-funded institutions of higher learning located in the province of Pangasinan into one institution...

Summary of Presidential Decree No. 1497

Establishment of Pangasinan State University
- Establishes a state university in Pangasinan province called the Pangasinan State University. (Section 1)
- Integrates existing state-supported higher education institutions in Pangasinan into the University. (Section 1)

Purpose and Functions
- Provide advanced instruction in arts, agricultural and natural sciences, technology, and professional fields. (Section 2)
- Serve as an instrument for rapid development of natural and human resources in Region I, particularly Pangasinan. (Whereas clause)

Governance
- Governed by a Board of Regents composed of: (Section 3)
- Minister of Education and Culture (Chairman)
- President of the University (Vice-Chairman)
- NEDA representative
- Two prominent citizens (one representing alumni, one from Pangasinan)
- Regents appointed by the President, with staggered terms of 2 and 4 years initially. (Section 3)
- Quorum requires majority of members, including Minister or President. (Section 4)
- Regents receive compensation and reimbursement for expenses. (Section 5)
- Board has general powers of administration and corporate powers. (Section 6)

Admission and Non-Discrimination
- No student shall be denied admission based on sex, nationality, religion, or political belief. (Section 7)

Administration
- President appointed by the President of the Philippines for 6 years, upon recommendation of the Minister. (Section 8)
- Administrative Council implements policies, composed of President, Vice-Presidents, Deans, Directors. (Section 9)
- Academic Council prescribes curricula, rules of discipline, admission and graduation requirements, and recommends degree recipients. (Section 10)

Faculty
- Faculty exempt from civil service examination for appointment. (Section 11)
- No religious test applied for faculty appointment. (Section 11)

Finance and Assets
- Treasurer of the Philippines is ex-officio treasurer, audited by Commission on Audit. (Section 12)
- Assets, records, appropriations of integrated institutions transferred to the University. (Section 13)
- ₱1,000,000 appropriated initially, with subsequent funding in Annual Appropriation Act. (Section 17)

Implementation
- Minister of Education and Culture to take steps for implementation, create technical committee. (Section 15)
- Annual report on progress, conditions and needs to be submitted to the President. (Section 16)

Repealing Clause
- Republic Act No. 5705 and other contrary laws repealed or amended. (Section 18)
