EXECUTIVE ORDER NO. 397 April 3, 1990
ESTABLISHING THE SAMAR ISLAND DEVELOPMENT PROJECT OFFICE
WHEREAS, Samar Island, composed of the Provinces of Eastern Samar, Northern Samar and Samar and the City of Calbayog, is the third largest island in the country;
WHEREAS, there is a need to foster self-reliance and accelerate the implementation of projects in the Island so that development efforts will be more meaningful and effective;
WHEREAS, the National Economic and Development Authority Board has approved the Samar Island Development Program (SIDP) for the development of Samar Island;
WHEREAS, the SIDP recognizes the different roles of the national offices, local government units, non-government organizations, and the private sector in accelerating the development of the Island of Samar and uplifting the socio-economic status of its population;
WHEREAS, there is a need for an effective and viable mechanism consistent with the provisions of Executive Order No. 363, series of 1989;

Summary of Executive Order No. 397
Establishment of the Samar Island Development Project Office (SIDPO)
- An ad hoc administrative mechanism under the Office of the President is established for the formulation and implementation of development programs and projects for the Island of Samar. (Section 1)
- The SIDPO is composed of a Project Governing Board and a Project Management Unit with principal office in Catbalogan, Samar.
Composition and Functions of the Project Governing Board
- The Board is composed of the Provincial Governors of Eastern Samar, Northern Samar, and Samar, the City Mayor of Calbayog City, two private sector representatives designated by the President, and the Executive Director of the Project Management Unit. (Section 2)
- The NEDA Regional Director is a non-voting member.
- The Board's functions include:
- Formulating development goals and policies for the SIDP (Section 2a)
- Mobilizing support and assistance for Samar Island development (Section 2b)
- Consulting Members of Congress from Samar Island (Section 2c)
- Calling upon provincial, city, and municipal governments and agencies for assistance (Section 2d)
- Reviewing and approving multi-year and annual plans and investment programs (Section 2e)
- Overseeing and coordinating work, fund programming, and project implementation (Section 2f)
- Organizing, supervising, and controlling the PMU operations, approving the annual budget, and entering into contracts (Section 2g)
- Submitting quarterly progress reports to the Office of the President, RDC, and Congress (Section 2h)
Functions and Structure of the Project Management Unit (PMU)
- The PMU assists the Board in undertaking the day-to-day activities of the SIDPO. (Section 3)
- The PMU's functions include:
- Serving as the technical and administrative secretariat of the Board (Section 3a)
- Coordinating the preparation of multi-year and annual plans and investment programs (Section 3b)
- Coordinating with agencies, local government units, financing institutions, NGOs, and other entities in implementing the SIDP (Section 3c)
- Undertaking periodic review and evaluation of the SIDP and designing a program implementation and benefit monitoring and evaluation system (Section 3d)
- Performing other functions assigned by the Board (Section 3e)
- The PMU is headed by a full-time Executive Director appointed by the President.
- The PMU has technical and administrative support staff, with the structure and size determined by the Board.
- The Provincial Planning and Development Offices (PPDOs), City Planning and Development Office (CPDO), and Municipal Planning and Development Offices (MPDOs) assist in monitoring and coordinating program and project implementation.
Roles of Governors and City and Municipal Mayors
- The Provincial Governors, City Mayor of Calbayog, and Municipal Mayors, through their Planning and Development Offices (PDOs), have the following roles:
- Coordinating the preparation and consolidation of annual project work and financial plans (Section 4a)
- Coordinating, directing, supervising, and monitoring the implementation of approved SIDP projects (Section 4b)
- Implementing projects and activities assigned to them under the approved multi-year and annual SID Program (Section 4c)
- Submitting periodic reports on operations and performance to the SIDPO (Section 4d)
- Undertaking other functions deemed appropriate by the SIDPO (Section 4e)
Role of Line Agencies
- Line agencies are responsible for planning, work and fund programming, and project implementation of their respective Samar Island projects and development activities, subject to the direction, supervision, and control of the Project Governing Board. (Section 5)
- Line agencies are directed to second the necessary personnel to SIDPO to ensure effective planning, programming, and monitoring of project implementation.
Duration of the SIDPO
- The SIDPO has a term of five (5) years from the date of effectivity of this Executive Order. (Section 6)
- After the term, all assets and liabilities of the SIDPO shall be turned over to the Office of the President for proper disposal and liquidation.
Funding and Funds Flow
- The Department of Budget and Management (DBM) is directed to allocate Five Million Pesos (P5,000,000) for the initial year of operation of the SIDPO. (Section 7)
- Thereafter, the DBM shall provide the funding requirement for SIDPO operations under the budget of the Office of the President in the annual appropriations act.
- The DBM is further directed to release the SIDP Project Funds directly to provincial/city offices of implementing agencies and local government units, and the SIDP Project Office funds to the SIDPO, subject to applicable accounting and auditing rules and regulations.
Effectivity
- The Executive Order takes effect immediately. (Section 8)
