GRANTING THE NATIONAL IRRIGATION ADMINISTRATION AUTHORITY TO CONSTRUCT, DEVELOP, OPERATE AND MAINTAIN THE CASECNAN MULTI-PURPOSE IRRIGATION AND POWER PROJECT LOCATED WITHIN THE CASECNAN RIVER WATERSHED FOREST RESERVE IN THE PROVINCE OF NUEVA VISCAYA AND THE PANTABANGAN-CARRANGLAN WATERSHED IN THE PROVINCE OF NUEVA ECIJA IN CONSONANCE WITH THE AUTHORITY OF THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES OVER THE WATERSHED UNDER PROCLAMATION NO. 136 AND PROCLAMATION NO. 561, AS AMENDED
WHEREAS, Proclamation No. 136 (11 August 1987) placed the administration, control and management of the Casecnan River Watershed Forest Reserve under the Department of Environment and Natural Resources, through the Bureau of Forest Development (now the Forest Management Bureau), in coordination with the other government agencies, with the objective of maintaining its usefulness as a source of water for agricultural and other forestry purposes;

Granting the National irrigation administration authority to construct, develop, operate and maintain the casecnan multi-purpose irrigation and power project located within the casecnan river watershed forest reserve in the province of nueva viscaya and the pantabangan-carranglan watershed in the province of nueva ecija in consonance with the authority of the department of environment and natural resources over the watershed under proclamation no. 136 and proclamation no. 561, as amended

Summary of Executive Order No. 281
Granting Authority to the National Irrigation Administration (NIA)
• Grants NIA the authority to construct, develop, operate and maintain the Casecnan Multi-Purpose Irrigation and Power Project (CMIPP) within certain areas of the Casecnan River Watershed Forest Reserve and Pantabangan-Carranglan Watershed. (Section 1)
• Allows NIA to grant necessary rights to the CMIPP developer under the Build-Operate-Transfer arrangement. (Section 1)
• Authorizes NIA to enter into contracts for the implementation of CMIPP. (Section 2)
Jurisdiction and Responsibilities
• The Department of Environment and Natural Resources (DENR) retains jurisdiction over the Casecnan River Watershed Forest Reserve and Pantabangan-Carranglan Watershed, subject to NIA's rights granted in Section 1. (Section 3)
• NIA and DENR shall consult and collaborate to ensure the protection of the watersheds. (Section 4)
• DENR's right to undertake projects within the Project Area pursuant to its mandate is not impaired, but no activities inconsistent with CMIPP shall be authorized. (Section 5)
Implementation and Coordination
• Concerned government agencies and local government units are directed to take necessary actions for full and expeditious implementation. (Section 6)
• NIA and DENR shall respect the applicable rights of indigenous cultural communities within the Project Area. (Section 7)
• NIA and DENR shall execute a Memorandum of Agreement to provide for their specific responsibilities and may revise or amend it as necessary. (Section 8)
• In case of any dispute, NIA and DENR shall immediately consult each other for resolution. (Section 9)
Legal Provisions
• Inconsistent provisions of proclamations, executive orders, instructions, rules and regulations are repealed, amended or modified accordingly. (Section 10)
• The Executive Order takes effect immediately. (Section 11)
