EXECUTIVE ORDER NO. 443 January 3, 1991

IMPOSING AN ADDITIONAL DUTY OF NINE PERCENT (9%) AD VALOREM ON ALL IMPORTED ARTICLES SUBJECT TO CERTAIN EXCEPTIONS AND CONDITIONS

WHEREAS, the prevailing situation has made it imperative to provide urgent measures to finance our oil importations and the budgetary requirements of our economic development efforts;

WHEREAS, among the necessary measures to attain these objectives is to impose an additional nine percent (9%) import duty on all imports;

NOW, THEREFORE, I, CORAZON C. AQUINO President of the Philippines, by virtue of the powers vested in me by law, do hereby order;

Sec. 1. Imposition of Additional Duty. Except as herein specifically provided, there shall be levied, collected and paid, in addition to any other duties, taxes and charges imposed by law on all articles imported into the Philippines, an additional duty of nine percent (9%) ad valorem.

Summary of Executive Order No. 443

Imposition of Additional Import Duty
- An additional duty of nine percent (9%) ad valorem shall be levied, collected, and paid on all imported articles into the Philippines, in addition to any other duties, taxes, and charges imposed by law. (Section 1)
- The additional 9% duty shall also apply to imported articles that are exempt under existing laws, except for those listed as exempt importations. (Section 2)

Exempt Importations
- The following imported articles are exempt from the additional 9% duty: (Section 3)
    - Those conferred by effective international agreements to which the Philippines is a signatory.
    - Those for official use of foreign embassies under the Tariff and Customs Code.
    - Those for bonded manufacturing warehouses under Presidential Decree No. 1464.
    - Those for bonded smelting warehouses under Presidential Decree No. 1464.
    - Those for enterprises registered with the Export Processing Zone Authority under Presidential Decree No. 66.
    - Those for enterprises registered with the Philippine Veterans Investments and Development Corporation (PHIVIDEC) Authority under Presidential Decree No. 538.
    - Those released under bond under Section 105 of the Tariff and Customs Code.

Repealing Clause and Effectivity
- Executive Order No. 438 is repealed, and all other inconsistent executive orders, rules, and regulations are repealed or modified accordingly. (Section 4)
- This Executive Order shall take effect ten (10) days after publication in two (2) national newspapers of general circulation and shall remain effective until June 30, 1992, or unless sooner revoked or modified. (Section 5)
