EXECUTIVE ORDER NO. 328 April 23, 1996
MODIFYING THE NOMENCLATURE AND THE RATE OF IMPORT DUTY ON IMPORTED WHEAT FOR FOOD UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464), AS AMENDED
WHEREAS, importation of wheat for food is not subject to quantitative restrictions;
WHEREAS, Executive Order No. 313 increased the rate of duty on said commodity to 50%;
WHEREAS, it is necessary to revert the tariff rate thereon to its previous level;
WHEREAS, Sec. 401 of the Tariff and Customs Code of 1978 (Presidential Decree No. 1464), as amended, empowers the President to increase, reduce, or remove existing protective rates of import duty, including any necessary changes in classification, as well as to modify the form of duty upon the recommendation of the National Economic Development Authority;
NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Modification of Import Duty Rates for Wheat
- Amends the import duty rates under heading 1001.90 90 of the Harmonized System (HS) Tariff and Customs Code of the Philippines for wheat and meslin. (Section 1)
- Specifies the new rates of import duty effective on different dates:
- April 1996: 10% for wheat other than feed wheat
- July 1996 to 1999: 10% for wheat other than feed wheat
- 2000 onwards: 10% for wheat other than feed wheat (Section 1)
- The new rates apply to wheat entered or withdrawn from warehouses in the Philippines for consumption after the effectivity of the Executive Order. (Section 2)
- Revokes or modifies any inconsistent presidential issuances, administrative rules, and regulations. (Section 3)
- Takes effect immediately after publication in two newspapers of general circulation in the Philippines. (Section 4)
