• Background (Whereas clauses):
- The Philippines started implementing the CEPT tariff reductions effective January 1, 1994, under Executive Order No. 145 (1993).
- ASEAN member countries decided to accelerate the realization of AFTA from 2008 to 2003 (26th ASEAN Economic Ministers Meeting, September 1994).
- Agreed to eliminate the Temporary Exclusion List in five equal installments from January 1, 1996, to January 1, 2000, and include unprocessed agricultural products in the CEPT Scheme (26th ASEAN Economic Ministers Meeting, September 1994).
- Decided to phase in all PTA products into the CEPT Scheme for a single trading arrangement in ASEAN (Special ASEAN Economic Ministers Meeting, April 1995).
- Agreed that the implementation of the tariff reduction schedule under the new accelerated CEPT/AFTA time frame would start on January 1, 1996 (27th ASEAN Economic Ministers Meeting, September 1995).
• Provisions:
- Section 1: Articles listed in Annex "A" (Articles Granted Concessions Under the CEPT/AFTA) shall be subject to the ASEAN Common Effective Preferential Tariff rates for 1996, as indicated in Column 4 of Annex "A". Implementation for succeeding years shall be subject to separate Executive Orders.
- Section 2: Articles listed in Annex "B" (Articles for Phasing-in the CEPT/AFTA) shall be subject to the ASEAN rates for 1996, as indicated in Column 4 of Annex "B". Implementation for succeeding years shall be subject to separate Executive Orders.
- Section 3: If the basic (MFN) Philippine rate of duty on any article in Annexes "A" and "B" is subsequently lowered, the article shall automatically be accorded the corresponding reduced rate.
- Section 4: The Margins of Preference (MOPs) under the ASEAN Preferential Trading Arrangements (PTA) shall no longer be extended to products listed in Annexes "A" and "B".
- Section 5: From the effective date, articles listed in Annexes "A" and "B" entered or withdrawn from warehouses in the Philippines for consumption shall be imposed the prescribed 1996 rates, subject to qualification under the Rules of Origin for the CEPT Scheme for AFTA.
- Section 6: Repeals or amends contrary or inconsistent decrees, orders, issuances, rules, and regulations.
- Section 7: This Executive Order shall take effect on January 1, 1996.

MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED FOR UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE 1996 PHILIPPINE SCHEDULE OF TARIFF REDUCTION UNDER THE NEW TIME FRAME OF THE ACCELERATED COMMON EFFECTIVE PREFERENTIAL TARIFF (CEPT) SCHEME FOR THE ASEAN FREE TRADE AREA (AFTA)
WHEREAS, under Executive Order No. 145, Series of 1993, the Philippines started the implementation of the CEPT tariff reductions effective 1 January 1994;
WHEREAS, at the Twenty-Sixth Meeting of the ASEAN Economic Ministers held in Chiangmai, Thailand from 22-23 September 1994, the ASEAN member countries decided to accelerate the realization of AFTA from 2008 to 2003;
WHEREAS, during the same Meeting, the ASEAN Economic Ministers agreed on the elimination of the Temporary Exclusion List in five equal installments beginning 1 January 1996 and ending 1 January 2000 and on the inclusion of unprocessed agricultural products into the CEPT Scheme for AFTA;
