MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED FOR UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE 2001-2003 PHILIPPINE SCHEDULE OF TARIFF REDUCTION UNDER THE BOLD ECONOMIC MEASURE INITIATIVES OF THE ACCELERATED COMMON EFFECTIVE PREFERENTIAL TARIFF (CEPT) SCHEME FOR THE ASEAN FREE TRADE AREA (AFTA) AND THE TRANSFER OF PRODUCTS FROM THE UNPROCESSED AGRICULTURAL PRODUCTS TEMPORARY EXCLUSION LIST (UAP-TEL) AND GENERAL EXEMPTION (GE) LIST TO THE CEPT INCLUSION LIST (CEPT-IL)

WHEREAS, at the conclusion of the 6th ASEAN Summit held in Hanoi, Vietnam on 15-16 December 1999, the ASEAN Heads of State and Government agreed to adopt a number of "bold" economic measures aimed at restoring regional economic growth and hastening the recovery from the Asian financial crisis;

This Executive Order modifies the rates of duty on certain imported articles to implement the 2001-2003 Philippine Schedule of Tariff Reduction under the ASEAN Free Trade Area (AFTA) and transfers products from exclusion lists to the CEPT Inclusion List.

Key Provisions:

- Articles listed in Annex "A" shall be subject to the ASEAN Common Effective Preferential Tariff (CEPT) rates for 2001-2003 as indicated in Columns 4-6 of Annex "A". (Section 1)
- If the basic Philippine rate is lower than the CEPT rate, the lower rate shall apply. (Section 2)
- Products eligible for CEPT concessions not listed in Annex "A" shall be subject to rates under previous orders. (Section 3)
- Articles in Annex "A" shall be imposed the prescribed CEPT rates upon entry or withdrawal from warehouses, subject to Rules of Origin. (Section 4)
- Contrary or inconsistent issuances are repealed or modified. (Section 5)
- The Order takes effect immediately. (Section 6)

Annex "A" lists the specific tariff headings, descriptions, and CEPT rates for 2001-2003 covering various agricultural products like live poultry, meat and edible offal, fish, vegetables, fruits, grains, nuts, chocolate, pasta, baked goods, preserved foods, juices, sauces, ice cream, non-alcoholic beverages, spirits, vinegar, and tobacco.
