EXECUTIVE ORDER NO. 767 November 7, 2008

MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED FOR UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE COMMITMENT TO REDUCE TARIFF RATES ON CERTAIN PRODUCTS INCLUDED IN THE AGREEMENT BETWEEN THE REPUBLIC OF THE PHILIPPINES AND JAPAN FOR AN ECONOMIC PARTNERSHIP

WHEREAS, a dynamic and rapidly changing global environment brought about by globalization and technological progress presents many new economic and strategic challenges and opportunities to the Philippines and Japan;

WHEREAS, the Agreement between the Republic of the Philippines and Japan for an Economic Partnership was signed by the Heads of Government of the aforesaid countries on 9 September 2006;

WHEREAS, the economic partnership would create larger and new markets, improve efficiency and enhance consumer welfare that would boost the vibrancy of economies, and thereby expand trade and investment not only between the Philippines and Japan but also in the region;

Summary of Executive Order No. 767

Modifying Tariff Rates on Certain Imported Articles from Japan
- Pursuant to the Agreement between the Philippines and Japan for an Economic Partnership signed on September 9, 2006.
- Aims to liberalize and facilitate trade in goods through reduction or elimination of duties.

Key Provisions:
- Section 1: Articles listed in the Annex shall be subject to the rates of duty indicated in Columns 4 to 14 of the Annex when imported from Japan.
- Section 2: Rates of duty represented with symbol "R" shall be subject to negotiations in the fourth year from entry into force of the Agreement.
- Section 3: Rates of duty represented with symbol "S" shall be subject to negotiations in 2009.
- Section 4: Upon effectivity, listed articles entered or withdrawn from warehouses in the Philippines for consumption shall be levied the prescribed rates of duty, subject to compliance with the Rules of Origin under the Agreement.
- Section 5: Repeals or modifies inconsistent presidential issuances, administrative rules and regulations.
- Section 6: Takes effect 15 days after complete publication in a newspaper of general circulation in the Philippines.
