MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE 10% MARGIN OF PREFERENCE (MOP) GRANTED BY THE PHILIPPINES UNDER THE AGREEMENT ON THE GLOBAL SYSTEM OF TRADE PREFERENCES AMONG DEVELOPING THE PHILIPPINE SCHEDULE OF CONCESSION ANNEXED TO THE AGREEMENT
WHEREAS, the Philippines, along with 47 developing countries, is a participant in the Agreement on the Global System of Trade Preferences (GSTP) Among Developing Countries signed in Belgrade, Yugoslavia, on 13 April 1988;
WHEREAS, the GSTP aims to promote and sustain mutual trade, foster collective self-reliance and enhance economic cooperation among developing member-countries of the Group of 77 through exchanges of trade concessions;

Background and Purpose:
- The Philippines is a participant in the Agreement on the Global System of Trade Preferences (GSTP) among developing countries, which aims to promote mutual trade and economic cooperation through exchanges of trade concessions.
- The Philippines exchanged direct tariff concessions with South Korea and India during the First Round of Trade Negotiations under the GSTP.
- This Executive Order implements the 10% Margin of Preference (MOP) granted by the Philippines under the GSTP Agreement.
Provisions:
- Articles listed in Annex "A" shall be accorded a 10% MOP, as shown in Column 9 of Annex "A". These articles shall be subject to the Preferential Tariffs indicated in Columns 10-14 of Annex "A". (Section 1)
- If there are subsequent changes in the basic Philippine rate of duty on any of the articles listed in Annex "A", such articles shall be automatically accorded the corresponding MOP indicated in Column 9 of Annex "A". (Section 2)
- The MOP shall apply only to imports from participants in the GSTP Agreement, as defined in Article 1(a) of the Agreement. (Section 3)
- After the effective date of this Order, all the described articles entered or withdrawn from warehouses in the Philippines for consumption shall be subject to qualification under the Rules of Origin prescribed in the GSTP Agreement. (Section 4)
- The Order took effect on January 1, 1994. (Section 5)
