MODIFYING THE RATES OF DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE PREFERENTIAL TARIFF RATES ON CERTAIN PRODUCTS UNDER THE ASEAN INDUSTRIAL COOPERATION (AICO) SCHEME
WHEREAS, the Philippines is a Contracting Party to the Basic Agreement on the ASEAN Industrial Cooperation (AICO) Scheme signed in Singapore on27 April 1996;
WHEREAS, the Philippines is a participating country in the approved AICO Arrangement of Ford Motor Company Philippines, Inc. and Laguna Autoparts Mfg., Corp. (LAMCOR), both along with Thailand;
WHEREAS, under the FORD AICO Arrangement, the Philippines (Ford Motor Co. Phils. Inc.) will import from Thailand certain original equipment manufacturer (OEM) automotive parts/components for FORD Laser LYNX passenger cars (HS 8703.90 10) and Ford Ranger Pick-ups (HS 8704.90 10). In exchange, Thailand will import from the Philippines complementary component parts for the OEM of FORD Laser LYNX passenger cars;

Modifying the Rates of Duty on Certain Imported Articles to Implement Preferential Tariff Rates under the ASEAN Industrial Cooperation (AICO) Scheme
- The Philippines is a party to the ASEAN Industrial Cooperation (AICO) Scheme signed in 1996. (Whereas clauses)
- The Philippines participates in the approved AICO Arrangements of Ford Motor Company Philippines, Inc. and Laguna Autoparts Mfg., Corp. (LAMCOR) along with Thailand. (Whereas clauses)
- Under the Ford AICO Arrangement:
- The Philippines (Ford Motor Co. Phils. Inc.) will import certain automotive parts/components for Ford Laser LYNX cars (HS 8703.90 10) and Ford Ranger Pick-ups (HS 8704.90 10) from Thailand. (Section 1, Annex A)
- Thailand will import complementary component parts for Ford Laser LYNX cars from the Philippines. (Whereas clauses)
- Under the LAMCOR AICO Arrangement:
- The Philippines (Laguna Autoparts Mfg. Corp.) will import certain intermediate products for assembling alternators and starters from Thailand. (Sections 3-4, Annex B)
- Thailand will import complementary component parts for alternators and starters from the Philippines. (Whereas clauses)
- AICO Certificates of Eligibility were issued on January 3, 2000 for the Ford and LAMCOR AICO Arrangements. (Whereas clauses)
- Participating companies in the approved AICO Arrangements qualify for 0-5% preferential tariff rates from Thailand and the Philippines, effective within 45 days from the Certificate of Eligibility issuance. (Whereas clauses)
- The articles listed in Annex "A" shall be accorded the AICO rate of 5% for Laser LYNX car parts (HS 8703.90 10) and 3% for Ranger Pick-up parts (HS 8704.90 10) when imported from the AICO entity in Thailand. (Sections 1-2)
- The articles listed in Annex "B" shall be accorded the AICO rate of 3% for vacuum pump assemblies, yoke assemblies, rotor assemblies, and brackets when imported from the AICO entity in Thailand. (Sections 3-4)
- If the basic Philippine duty rate on any listed article is reduced below the AICO rate, the lower rate shall apply. Effective January 1, 2003, the final CEPT rate shall apply. (Section 5)
- The listed articles entered or withdrawn from warehouses in the Philippines for consumption shall pay the applicable AICO preferential tariff rates, subject to qualification under the CEPT Rules of Origin and Certificate of Origin - Form "D". (Section 6)
- Any revisions to the part numbers in the Annexes shall be communicated to the Bureau of Customs by the Board of Investments within 5 days after receipt from the ASEAN Secretariat. (Section 7)
- The Executive Order takes effect immediately. (Section 8)
