EXECUTIVE ORDER No. 450 July 22, 2005
MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN ARTICLES UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464), AS AMENDED
WHEREAS, it is the policy of the government to promote the development of sustainable, prosperous and internationally competitive domestic industries;
WHEREAS, certain manufacturing industries would gain greater competitiveness from a reduction in the cost of their imported inputs;
WHEREAS, Section 401 of the Tariff and Customs Code of 1978 (Presidential Decree No. 1464), as amended, empowers the President of the Republic of the Philippines to increase, reduce, or remove existing rates of import duty, as well as to modify the form of duty and the tariff nomenclature under Section 104 of said Code;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Modifying the Rates of Import Duty on Certain Articles
- Policy: Promote development of sustainable, prosperous and internationally competitive domestic industries. (Preamble)
- Certain manufacturing industries would gain competitiveness from reduced cost of imported inputs. (Preamble)
- President empowered to modify import duty rates under Section 401 of Tariff and Customs Code of 1978. (Preamble)
Provisions:
- Articles listed in Annex "A" shall be subject to Most-Favoured-Nation (MFN) rate of import duty as scheduled. (Section 1)
- Nomenclature and rates not listed shall remain in force. (Section 2)
- Listed articles withdrawn from warehouses for consumption shall be levied MFN rates prescribed. (Section 3)
- Contrary issuances revoked or modified accordingly. (Section 4)
- Effective 30 days after publication in two newspapers of general circulation. (Section 5)
Annex "A":
- Mechanical wood pulp, chemical wood pulp (soda, sulphate, sulphite) other than dissolving grades: 1% MFN rate (Headings 47.01, 47.03, 47.04)
- Stoppers, caps, lids, etc. of base metal:
  - Aerosol can ends (tops and bottoms) made of tinplate: 3% MFN rate (Heading 83.09)
  - Other: 10% MFN rate (Heading 83.09)
