MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED FOR IN THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE MARGINS OF PREFERENCE IN ACCORDANCE WITH THE ASEAN AGREEMENT OF PREFERENTIAL TRADING AGREEMENT WITH RESPECT TO CERTAIN ARTICLES NEGOTIATED DURING THE NINETEENTH AND TWENTIETH MEETING OF THE ASEAN COMMITTEE ON TRADE AND TOURISM.

Pursuant to the powers vested in me under Section 402 of the Tariff and Customs Code of 1978, as amended, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

Sec. 1. The articles specifically listed hereunder as classified under Section 104 of the Tariff and Customs Code of 1978, as amended, shall be accorded the margins of tariff preference as specified in Column 4. In effect, such articles shall be subject to the Preferential Tariff for ASEAN in Accordance with the schedule indicated opposite each article as specified in Column 5.

(Section 1) • The following articles are subject to the specified margins of preference and preferential tariff rates:     - Creams and balms (ex. 33.06): Additional 20% margin of preference, 30% preferential tariff rate. (Section 1)     - Reclaimed rubber (40.03): Additional 5% margin of preference, 15% preferential tariff rate. (Section 1)     - Sports gloves of leather (ex. 42.03): Additional 20% margin of preference, 30% preferential tariff rate. (Section 1)     - Longan in air tight containers (ex. 20.06): Additional 10% margin of preference, 35% preferential tariff rate. (Section 1)     - Tubes for toothpaste (ex. 76.10): Additional 5% margin of preference, 18% preferential tariff rate. (Section 1) • If there are subsequent changes in the basic Philippine rate of duty on any of the mentioned articles, the corresponding margins of preference shall automatically be accorded. (Section 2) • The articles shall be subject to qualification under the Rules of Origin prescribed in the Agreement on ASEAN Preferential Trading Arrangements ratified on August 1, 1977. (Section 3) • The Executive Order takes effect immediately.
