Executive Order No. 189

EXECUTIVE ORDER NO. 189 June 10, 1987

PLACING ALL PUBLIC SECONDARY SCHOOL TEACHERS UNDER THE ADMINISTRATIVE SUPERVISION AND CONTROL OF THE DEPARTMENT OF EDUCATION; CULTURE AND SPORTS AND FOR OTHER PURPOSES

WHEREAS, it is the declared policy of the national government to give priority to education, science and technology, arts, culture and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development.

WHEREAS, the State recognizes the vital role of the youth in nation building and the need to develop their physical, moral, spiritual, intellectual and social well-being;

WHEREAS, the State is mandated to establish and maintain a system of free education in the elementary and high schools levels;

WHEREAS, the State realizes the need to effectively implement this educational reform at the earliest possible time.

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order the following:

Summary of Executive Order No. 189

Nationalization of Public Secondary School Teachers
- All public secondary school teachers are placed under the administrative supervision and control of the Department of Education, Culture and Sports. (Sec. 1)
- Their basic salaries and cost of living allowances shall be paid by the national government. (Sec. 1)

Appointment of Teachers
- Appointment of public secondary school teachers shall follow rules, regulations, and standards applicable to national government employees. (Sec. 2)

Teacher Compensation
- Salaries and cost of living allowances of nationalized teachers shall be paid according to rates prescribed for their national counterparts. (Sec. 3)
- If nationalized teachers' salaries and allowances exceed those of national counterparts, the excess shall continue to be paid by their respective local governments. (Sec. 3)

Funding Sources and Administration
- Salaries and allowances shall be taken from the Special Education Fund (Republic Act No. 5447, as amended), National Aid to Local Schools (Executive Order No. 87), and other funds determined by the Department of Budget and Management. (Sec. 4)
- The funds shall be administered by the Department of Education, Culture and Sports. (Sec. 4)

Special Education Fund
- Starting July 1, 1987, 80% of all collections accruing to the Special Education Fund shall be remitted immediately to the National Treasury. (Sec. 5)
- If local government units fail to remit the prescribed amount, the Department of Budget and Management shall withhold a corresponding amount from their share of national internal revenue. (Sec. 5)

Supplemental Appropriation
- Six Hundred Million Pesos (P600,000,000.00) is appropriated to carry out the provisions of this Order, taken from the sources mentioned in Section 4. (Sec. 6)
- Necessary amounts shall be provided for in the General Appropriations Act thereafter. (Sec. 6)

Implementing Rules and Regulations
- The Department of Budget and Management and the Department of Education, Culture and Sports shall jointly issue the necessary rules and regulations to implement this Order. (Sec. 7)

Effectivity
- This Executive Order shall take effect immediately. (Sec. 8)
