EXECUTIVE ORDER NO. 238 July 22, 1987

PLACING THE KILUSANG KABUHAYAN AT KAUNLARAN (KKK) CAPITAL AND ITS EARNINGS UNDER THE CONTROL AND SUPERVISION OF THE OFFICE OF THE PRESIDENT AND FOR OTHER PURPOSES

WHEREAS, under the established livelihood fund delivery systems, the Kilusang Kabuhayan at Kaunlaran (KKK)-National Secretariat directs the release, delivery and utilization of said funds in accordance with existing policies, rules and regulations;

WHEREAS, there is now more than ever a need to promote, generate and develop livelihood opportunities;

WHEREAS, there is an urgent need for a clear mandate to direct the release, delivery and utilization of the KKK Capital Fund and its earnings, if the government is to promote, generate and develop effectively and expeditiously livelihood opportunities now and in the immediate future;

WHEREAS, pursuant to Executive Order No. 85, S. 1986, the MHS was abolished; the specific provisions and intent of Executive Order No. 130, S. 1987, placed the KKK under the supervision and control of the Office of the President, Presidential Management Staff (PMS),...

Executive Order No. 238

Placing the Kilusang Kabuhayan at Kaunlaran (KKK) Capital and its Earnings Under the Control and Supervision of the Office of the President

- The Kilusang Kabuhayan at Kaunlaran (KKK) Capital Fund/National Livelihood Support Fund shall be exclusively utilized for the promotion, generation, and development of livelihood opportunities under the control and supervision of the Office of the President. (Section 1)
- The Central Bank of the Philippines, KKK-designated banks, and other entities dealing with the KKK Capital Fund/National Livelihood Support Fund are directed to deliver all or part of said funds, including their earnings, to the Office of the President. (Section 2)
- The Office of the President shall consolidate the funds, transfer or distribute them to different accounts, or cause their deposit in one or more depositories, consistent with the purpose of the KKK Capital Fund/National Livelihood Support Fund. (Section 3)
- The Office of the President shall establish new fund delivery systems in addition to or in lieu of existing ones, and all fund releases shall be in accordance with such delivery systems and policies, rules, and regulations issued by the Office of the President to implement the purpose of the Executive Order. (Section 4)
- All orders, issuances, rules, and regulations inconsistent with this Executive Order are repealed or modified accordingly. (Section 5)
- Any unconstitutional portion or provision of this Executive Order shall not nullify other portions or provisions that can still subsist and be given effect in their entirety. (Section 6)
- This Executive Order shall take effect immediately. (Section 7)
