PRESIDENTIAL DECREE No. 814 October 17, 1975

PRESCRIBING THE LAND TENURE SYSTEM FOR THE TONDO FORESHORE AND DAGAT-DAGATAN URBAN DEVELOPMENT PROJECT

WHEREAS, the government recognizes the need to rationalize the use of land particularly in urban areas to insure its optimum utilization for the welfare of the greatest number of people;

WHEREAS, it is the declared policy of government to promote the well being of the people by undertaking a program of development which shall establish communities where people can live with dignity in healthful environmental conditions;

WHEREAS, the Tondo Foreshore is the largest squatter and slum colony in the Greater Manila Area where people live in substandard conditions incompatible with the goals of the New Society;

WHEREAS, the government is determined to improve the quality of life of the people in the Tondo Foreshore by preparing and implementing a realistic, comprehensive, and integrated plan for its development;

Summary of Presidential Decree No. 814

Land Tenure System for the Tondo Foreshore and Dagat-dagatan Urban Development Project

- Prescribes a new and realistic land tenure system for the Tondo Foreshore area and Dagat-dagatan resettlement site to effect the proper implementation of the physical and socio-economic development program. (Section 1)

- Two modes of residential land ownership and disposition:
    1. Freehold with restrictions (Section 2a)
        - Applied to titled lots and claims with "vested rights" like final Deeds of Sales, Agreements to sell, and other legal claims honored by the Authority.
        - Owners of legal rights may opt for leasehold with option to purchase arrangement.
    2. Leasehold with or without the option to purchase (Section 2b)
        - Applied to untitled, vacant, unclaimed lands without vested rights.

- Citizens' Committee formed in each barangay within the Project Area to: (Section 3)
    - Process requests for transfer of residential land rights and sub-letting of dwelling units and structures based on Authority's policies.
    - Submit recommendations on such transfers and sub-letting to the Authority for review and approval.
    - Composed of 5 members, including the Barangay Chairman and 4 elected members serving 1-year terms.

- Conditions for Freehold with Restrictions: (Section 4)
    - Land cannot be transferred, alienated, conveyed, or disposed of to any person not meeting the Authority's criteria, except by hereditary succession.
    - Use, occupancy, and development of land subject to Authority's regulations and approved development plan.
    - Freehold land assessed a fee covering development cost, amortized on a perpetual basis.

- Conditions for Leasehold with Option to Purchase: (Section 5)
    - Lease grants for 25 years, renewable for another 25 years.
    - After 5 years of continuous occupancy, lessee may purchase the land at market value assessed at the time of application.
    - A specified percentage of lease payments credited against the purchase price.
    - After full payment, lessee owns the land with restrictions under Section 4.
    - Lease amount determined by the Authority to cover development costs, with provision for gradual increase over time.
    - Lease rights may be transferred or sold to another qualified person, subject to Citizens' Committee approval and Authority's review.

- Sub-letting of dwelling units and structures subject to Citizens' Committee recommendation and Authority's approval. (Section 6)

- Commercial and Industrial lands disposed of by sale and/or lease, with conditions prescribed and implemented by the Authority. (Section 7)

- Lessees and freehold title holders shall pay normal real property taxes to the local government in return for normal services. (Section 8)

- The Authority shall implement and administer the land tenure system in the project. (Section 9)
